Owner for 5 days. Passenger side totalled!

Just catching up with this. Really sorry to hear about your misfortune. I think I hope you get it written off and are able to find something just as nice with the payout, because I'm not sure I'd want it back after that much damage.

Technically they have to put you back to the same position you were in, the car could have been worth more than you paid for it (think classic cars that go up in potentially £100ks per annum/convertibles going up in value in summer) - so it should not be classed as betterment if you are only asking for the equivalent of what you already had.
 
I do think with only owning the car 5 days and being on BMW's insurance the best you will get is what you paid. I cannot see them giving more.
 
Looking on Autotrader, there's no Autos under £13,000 unless coupes. Not to mention no suitable AU BMWs. Can't see me getting what I want out of this.

Maybe it won't be written off. I'm going to get straight into BMW insurance in the morning. Ludicrous that they couldn't take the details until tomorrow because they're were too busy with non-drivable claims.

BMW aren't paying out, its the third parties insurers who will be footing the bill, BMW will be happy to take even more (and as much as possible) money from them.

True, depends how much info the 3rd party insurance gets then.

Get the BMW dealer to find you an equivalent car, give info to third party - let them fight with BMW. They'll struggle to get out of it if you've just bought an AUC and want another one, plus if they want you to wait for a cheaper one to come along, fine they'll have to pay for an equivalent hire car for you for that period (i.e. £££'s). Insurers always look to limit costs so I'm sure they will pay up a little over the odds if it saves them £150 a day in hire car costs.

An example of how hire cars can be the most expensive part of a claim is this: I had a Civic Type R (Brand new 06 plate) and someone went into the back of it on the motorway, it took 8 weeks to get a bumper from Japan, the claim came to £9500 because they wouldn't let me drive the car without a bumper - part was about £450 painted.

Mrs Ewazix had very similar damage in our 4 year old mint 'garage queen' cooper convertible which we had from new being pretty one of the first in the UK. As it turned out it was nowhere near a write-off, even after a severe wrangle with the insurance co as I was insisting on genuine BMW parts. It was all sorted and undetectable in the end but I sold it as I never felt the same about it. I hope it works out.
 
What a crap start to your new car experience. Some good advice on the thread. Nothing further to add apart from don't let the insurance companies dictate to you, make sure you get a deal that you are happy with.
 
Only thing I would add is that if you have a replacement car provided whether by your insurer or otherwise then the 3rd party's insurers will be a lot more pro-active in terms of bringing the whole sorry mess to an appropriate conclusion. As soon as they realise that there is no grounds for disputing liability and the longer it trundles on the more they will have to pay out to cover your consequential losses they will move the paperwork on a heck of a lot faster.
 
Thanks all. Dropping her off at my local BMW dealer now. It's all being sorted by my BMW insurance then they'll claim back. Should get a courtesy car tomorrow.
 
At BMW now. I'm extremely surprised that they're getting me a class a enterprise car (likely a Ford Ka or similar).

I was expecting a similar standard of car so I've complained. Am I not within my rights to claim this??

I would ask them to use their accident management company they appoint to take care of this. You will end up with a much better car and speedier service
 
It's very unlikely that your policy will provide the same standard of car as your own but once they're confident they're not on the hook for the bill they might be prepared to provide a better car and claim it from the third party insurers.

I think it all comes to what is reasonable, if you had a 7 seater you could argue that you can't get your family around in a small 2 door car but I don't think you can just argue that you want a 2 seat sports car over 2 door hatch.
 
As long as they are certain you are not to blame and the other party accept liability, then you should call a company called Accident Exchange, and let them get details from you. Once they have, they will decide as to whether they help you or not. They do not try to claim money back from you if they hit issues. They are used by quite a few BMW dealers
 
I'd use the advice above...

As you are claiming from your insurance and then they are claiming back.. they are allocating a car which you would get if you were at fault.. i.e the cheapest.

Using the above company you will be treated with minimal inconvenienced.. i.e equivalent or better car... why should you suffer for someone elses fault?
 
I wouldn't give anyone your normal mobile number, maybe buy a cheap sim only card from a supermarket and throw it away once your claim has finished.....otherwise expect to receive telephone calls and texts for the next 1/2/3/4/5 years...

Hope you get another equal car soon.
