Thanks, I love white in these but I bought a 318 sport in white and there was no way I was having 2 white cars, so red was next in line for me,
The e89 is rare over here, only seen 2 since 2009

nightmare

so after months of messing about my car only went into BMW last week to get fixed and i got it back on friday.
i got a new bumper but it does not line up with the car, 10mm on one side 1mm on the other, whole thing just looks wrong
none of the scratches / swirl marks have been removed
they did not replace the 2 black window pillars
and i just found a flaw on the roof / like what was on the bumper when it was resprayed (dust flaw from spraying) can this happen in a factory paint shop.

totally pissed of with the car and just want a new one now.

think its time for a full car inspection and a solicitor. just cant do this any more
 
Try BMW customer services first, with a polite but firm letter telling them you want to reject the car after so much messing about. If they won't play, then talk to a solicitor. Carol got a result over her parking sensors/hill start and I think somebody else successfully rejected a car recently too.

That might be me! Got my car on March 31 and within a week noticed a leak on the passenger door whenever it was in prolonged rain. Long story short : after 4 months and 6 visits to the dealer totalling 44 days, with them eventually changing all seals, they have agreed to replace it. I did have to fight, but the replacement has been ordered and due end of Sept.

My take on it is this : the car was supplied faulty and despite them trying to fix it, they couldn't, so I want a replacement. As a consumer, you are buying a product brand new and you should be entitled to a product with no faults. Your car was imperfect and they've now tried to rectify it and failed.

Is it on BMW finance? I rang BMW customer services and they told me to deal with the dealer. So I sent a long letter to Dealer, BMW Customer Services and also BMW Finance. From sending letter to getting a replacement authorised took 3 or 4 weeks and I had to keep on top of it...depends how good your dealer is. If yours is "just cosmetic" then the threat of rejection might make them take a bit more care and actually fix it, or the ongoing failure of them to do so might give you a strong case for rejection.

I would write a letter explaining the problems with the car - from day 1 etc, the visits to the dealer for rectification etc and the current state of affairs. Then list what you would expect to be done and send it off. Dont get emotional, stay to the facts.
 
Just got a call to meet with the deal on manday night to hopefully discuss a new car , well so they said on the phone.

They cannot fix my car with out a respray

As the deal at the time was 28k for a 23i and it is now 33k for a 20i they want me to pay the 5k extra and take a new 4 year finance deal.
Unbelievable

Fed up with the whole thing. Life is to short for this s**t,
I paid for a new car so I should get a new car.
 
My solictor want give them 7 days to replace the car,full refund, then start court proceedings

I do not want a refund but I may have to take one
 
You'd be surprised how fast things will progress when a summons turns up. Horrid that it has to happen that way, but it sounds like they are playing "who blinks first"
 
The deal at the time should stand...several of us have had replacement cars on the same deal. Is yours a 23i? I guess that might be a stumbling block as they don't make those now...but they should give you the equivalent!

What do BMW Finance say?
 
Yes mine is the 23i
I stopped my solictor contacting BMW finance as the dealer told me we could sort it out between us.
They say that the 20i is the replacement for the 23i.

I'm seriously thinking not buying new again or maybe switching to Japanese. Every new non Japanese car I've had I've experienced some problems in one shape or another. My last 2 BMWs were ex demo's 3 to 4 months old and had no problems as they were probably sorted out in the first few months. My Z3 is 11 years old and I've had no problems in the past 4 years of ownership, but buying new seems to be a nightmare when it should be the opposite. Pretty poor really considering what they cost.

Not in my experience. BMW wouldn't touch anything they damaged and they didn't even try this on as the loss of the contract was unthinkable.

They used to use the damaged vehicles as fleet in their own business.

I think it's more likely that the garage has managed to do something to the car after it got there like shunt it while parking :cry:

This isn't an argument about merchantable quality. You paid for a brand new car, not an accident damaged repaired used car. Take it back and demand a replacement to the same spec at their expense. No excuses, no arguments. BMW UK if they refuse followed by press coverage of their dealership.
