I think your on a hiding to nothing. As you’ve pointed out it’s on the video and you didn’t spot it also. They’ve reduced the cost on the other marks and at the end of the day it’s a used car.

I’d be very surprised if you get anything. Citizens advice/ trading standards won’t want to know either. Small claims court would be your only other option, and even then I think you’d struggle.
 
As others have said, being polite and friendly (at least to start with) is your best option.

Don’t go immediately to the dealer principal, keep that in reserve, go to the person who dealt with the sale in the first instance.

They will know exactly what they can and can’t get away with (legally) and at best you’re depending on good will in this case IMHO

Starting with threats of small claims court and claiming to be a lawyer won’t get you anywhere and will just get their backs up.

As many may know by now, I recently purchased a 2013 E89. Due to Covid it was bought unseen from a major stealer (Arnold Clark). I got a walkround video upon enquiry and I asked for them to highlight any issues with the bodywork. They did highlight scuffed alloys, a small piece of damage to the lower front bumper and a couple of "stone chip" type marks and small scuffing on the driver seat bolster. The car has their own (I presume) 60 day warranty. I have had the car for 19 days now.

I noticed for the first time yesterday that the middle of the rear bumper, directly under the number plate, has some damage. It is easy to miss as this is dark grey/black and the car is white. It looks like someone has reversed into a tow bar or a tow bar has reversed into it. It has pushed the plastic in and bulged top and bottom. I cannot repair this. I am guessing it will need a new skirt which will be bl00dy expensive.

My question is; should I talk to them about claiming the bumper under their warranty, as it wasn't picked up on the walkround video therefore I was unaware of it. I am wondering if the "distance selling" rules would make any difference in this situation? I would like a bit of knowledge otherwise I will just ring them and start shouting if they say "up yours".
If anyone has any knowledge of this type of thing I would be grateful.
Correct me if I'm wrong but you can return the car for repair or refund within the first 30 days of ownership :?
 
I think the Covid selling rules are an open invitation to dealers to be economical with the truth

I think they should point out faults that would reasonably be expected to be found by anyone looking closely at the car.
They haven't even taken the trouble to remove the raindrops from the paintwork which makes you even more reliant on their honesty.

Having said all that it sounds like you were more than happy with the price, so you have to judge if, after getting the repair done, the price is still reasonable.

It looks like a nice car to me!
 
Also thought it was poor of the salesman to say the mark on the rear passenger side "should probably buff out". Surely if this was the case they could have easily done it.
 
I bought a car from BMW Park Lane sight unseen
The salesman said if not exactly as described, send it back with the delivery driver.

I didn’t have to - the car was not particularly cheap.
