Reasons for the Assessor’s Determination
On 25 August 2014, the appellant was issued with a parking charge notice for breaching the terms and conditions of the parking site.
It is the operator’s case that the appellant’s vehicle was parked outside of a marked bay despite signage at the site to indicate that this was necessary to do so.
The appellant has made a number of submissions, however, I will only elaborate on the one submission that I am allowing this appeal on, namely that the parking charge amount is not a genuine pre-estimate of loss.
In order to justify that the amount is a genuine pre-estimate of loss, the operator has submitted a breakdown of the losses incurred as a result of the appellant’s breach. Amongst other things, the operator has included “Site based” costs. Although a detailed breakdown may not necessarily be required to prove this, as the appellant has questioned the level of the charge in this case, it is necessary for the operator to provide an explanation as to how this sum was arrived at as an estimate of the damage which could be caused by the appellant’s alleged breach. The operator has stated, “The site-based costs include (but are not limited to) the cost of producing the charge itself with accompanying weatherproof wallet, which directly relates to the breach.” However, I find that the operator has failed to show how a sum of £36.21 has been calculated on these items alone. On this occasion, I am not satisfied that the operator has discharged the burden.
Accordingly, this appeal must be allowed.
 
Yes, was pleased about that. Found the whole thing very infuriating and could not believe that it was possible that these companies can even exist. It felt similar to someone walking over my drive, and me putting a sign somewhere that anyone crossing it has to pay me £100 - and the law allowing me to find out who they are.

At least UKPC has wasted £27 on this, small comfort that it has costed them money in the end. However, it has cost me a lot of time preparing 4 pages of legally sound arguments rather than a rambling about how stupid it all is :)
 
Not offering advice but I was in the right with two clients that tried to get out of paying their invoices. I took both of them to court and lost. The unpaid invoices and legal fees amounted to £25k. Lesson learnt was don't assume that just because you are honest, other people who appear to be honest are not necessarily so, and just because you are in the right, you don't necessarily win.
What's made me cross(other than being shafted for £25K), is that I always tried to see the good in people and trust them and now I've become a bit cynical.

There is a test case soon regarding the ability of companies to charge parking penalties. Didn't hear the full report but it was reported on LBC.
 
I hope that these parking companies and their sharp practices Foxtrot Oscar. Just a personal opinion.
 
Congrats, I won one with Parking Eye earlier this year thanks to advice on Money Saving Expert, same reason as you. These companies need to be stopped.
