Turning around in a private cul-de-sac...

My understanding is that whether a road is maintainable at public expense or not is irrelevant to whether it is a highway or not. Usually, a private street that is also a highway will have come into being as a highway by prescription i.e. long usage by the public as a right of way and without interruption. The right of way may however be for pedestrians, equestrians or some or all classes of vehicles.

More inportantly, it can be confusing to owners of private streets in that the term “private” does not necessarily mean that the owner has discretion over what happens on his/her land.
 
We own the side of our house and its a public right of way,but any trouble with drains etc we have to pay for :( -slightly off topic but its annoying!
 
Well, having simmered slightly from earlier I've found out the following. Turning in a private road is neither a police issue or a council issue. It can be dealt with as a civil issue (i.e. sue me for causing a nuisance) but at considerable cost and with little in the way of compensation.

I've decided to continue turning in the cul-de-sac in the hope the aggressive guy confronts me again. I'll tell him the above but that if he decides to talk to me in a civil and polite manner, my attitude will completely change. He strikes me as a bully who won't have it in him but we'll see what happens over the next week. :thumbsup: If he threatens me again, it will become a police matter.
 
As the guy, let's call him Richard Head for want of a better name :lol: is a former Police Officer he should know that by using this sort of behavior he is actually committing a Public Order Offence under Section 4(1)(a) of the act. Basically it covers threatening, abusive or insulting words or behavior towards another person in a public or private place, but not when confined to a dwelling house. Just make sure you have a witness, will help when complaining to police if someone can corroborate the incident
 
Organise a forum meet in his cul-de-sac, a couple of 'M's revving their chavvy sports exhausts outside his window would give him something to moan about :evil:
 
Further update. After a patchy nights sleep (he really got under my skin!) I've reported the incident to the police. They won't be visiting him but at least it's on record. In the meantime, a friend at the council has confirmed that the road is unadopted but that's it's not a criminal offence to turn around in it so I'll continue to do so. Should nobchops get all uppety again, I'll phone the OB there and then in front of him. :roll:
 
Good one mate - glad you got it sorted out (or at least know all the facts next time he starts mouthing off). We had a similar neighbour who used to give us abuse for parking across from their driveway (opposite side of a very wide road) to take shopping out the car before putting it in the driveway behind the house. Even had the cheek to shout at my mother as she was helping my dad out the car and up the path when he was fairly unwell after major surgery and a prolonged hospital stay. Thankfully the old bill were on our side and warned them that their antics were tantamount to harassment.
 
Thanks JP. I get the feeling there's another confrontation brewing but I won't be caught cold this time and will immediately lay out the ground rules if he's to communicate with me. Staying more than 12" from my nose would be a start. :roll:

I can't believe someone would moan at you for just temporarily parking to unload a car - disgusting. The sooner I can afford a country cottage with no neighbours within half a mile, the better!

Was reading this thread with interest actually. Good you know facts. I did wonder if it was the throatyness of your BMW, but as it's a littler car, what a funny man. Don't shout at him, not good to sink to idiots' depths.

Woah, not very nice thing to do to shout at your for letting your Dad get outta the car after surgery. :o
