This is why I (a cyclist) hate some motorists UPDATE DEC'12

I wasn't aware police work stopped when they went on holiday? So shoddy, witness statements should be taken immediately when the events are fresh in their mind. Fingers crossed for a good result, and fortunately you have the footage to make up for the lack of police evidence gathering.

Yep, I'm somewhat surprised at the lack of action so far. I dropped in a copy of my video footage to the police on Tuesday to try and spur them on, but as of today no action has been taken. To be fair the PC did say she'd be unlikely to speak to the witnesses last week due to working nightshift, but surely it'd be done as a matter of priority this week or at the very least - if she's too busy with more urgent issues - pass it onto someone else? I'm not sure how the police work TBH. but I'm holding off judgement until I've next spoken to them for an update...

Make a plea to the local superintendent. Details should be on local website mate

I'm pretty sure there are one or two police persons on the forum isn't there, maybe they can advise. Not sure but I think Swifty is a Bobby :?

I had the same issue when a car took 30 meters or so of my fence down that as the job had been allocated to a particular person, and that person was not on duty for a week after that - nothing happened until he was back on duty.

Not good, especially in your case where it was personal rather than against property.

Bloody hell, how did I miss this thread for so long?

Glad you're ok ally, hope the police & CPS do their job on this one. A mate of mine is a bobby in the Central Force but doubt he'd be able to help as he's Alloa based not Falkirk.

Well this looks similar to what happened to you Ally, although your incident didnt look quite as extreme or violent as this.

The result should be heartening to see.

Just reading those links, was there also CCTV in the area you were hit ally. I expect one video from your camera is damning enough to do the idiot, but to have two you'd hope would be inescapable for him.

This might be a repost of the above. But I just saw it on the skynews website

Sky News - Bus Driver Jailed For Using Vehicle As 'Weapon'. http://news.sky.com/skynews/Article/201202116171562

Guy got 17months for basically doing exactly as you describe.

Fucking tosser.

The police are generally pretty good, I am surprised they haven't taken the witness statements yet!?

Thanks for the links guys - yeah that's the one I posted earlier. Very scary. The driver that hit me displayed the exact same intent as that bus driver, with the only difference being the severity of the outcome for the cyclist. Not saying I expect the driver in my case to get 17 months but I certainly expect some sort of decent punishment given the two witnesses and my video evidence.

I try my hardest not to criticise the police as they do a very difficult job, but I too am surprised at the lack of activitiy so far. The PC is back on shift this morning and I've already called but she's on a call. I'm awaiting a call back...

UPDATE DEC 2012: just received notification that the driver pled GUILTY to the offences he was charged with - happy with that result.

Means that I no longer have to attend court - yay!

I understand the offences were:
1) Failing to Stop at the scene of an accident;
2) Failing to report an accident; and
3) Dangerous Driving (info as heard from the Proc Fiscal several months ago)

No idea if this video was used as evidence or not as several witnesses in following vehicles provided statements.

Glad the guy saw sense and pleaded guilty, dangerous driving is quite a difficult offence to prove is it not? Some punishment coming his way then!

Edit: Just watched the video, what an idiotic maniac he was. Echo what others have said really...

Good outcome.
I for one will call the police what they are in this one case. Idiots
When they had a bloody video that clearly showed the assault, the numberplate of the assailants car, And had multiple witnesses. There is no way it should have taken 11 months to apprehend this driver.

Ooops, I reinstated the video in the initial post but chronologically it makes sense for it to sit here in the thread, so here it is:

CAUTION: video sound probably NSFW :D

Just need to sort our reimbursement of the damage to my bike/clothing/etc with his insurance company now…

To be fair to the police, the charges were made within a few weeks and the report forwarded to the Procurator Fiscal (the Scottish equivalent of the Crown Prosecution Service in England). I won’t criticise the police on this occasion!

Was initially due to be heard in court in July but the accused deployed (in my opinion) delaying tactics of some sort: there were numerous hearings between the prosecution and the accused’s lawyer to debate some “points of law” – that’s all I know having been heard it from the Proc Fiscal’s office as I wasn’t involved.

I have some suspicions for why the accused was delaying the trial, but nothing concrete.

At least it's all sorted and you didn't need to go to court. Do you know what he was sentenced to?

Not yet but again it's something I'm asking the Proc Fiscal for :)
