The whole thing looks a bad design from the outset. When you look at the new photos you can see why she thought the flower bed was hers to plant in, half of it is. What were the developers thinking?! Was she suppose to plant in just half a flower bed? Crazy design. OP I would definitely check the land boundary's on Land Registry as the developer changed the design from the original you were shown/have plans of there is no guarantee the plans submitted to L/R are the same as the one you have. If it isn't the same your probably got an expensive fight on your hands to prove otherwise which would simply not be worth it for whats a stake.

If I'm honest I surprised its not been a issue before. I would have walked away as a buyer when I saw those windows opening directly on to my driveway/land as you have no privacy either. Its akin to living in a terrace and the house next door having a extension with windows opening directly on to your backyard without a fence. Your access to your drive is via the front/side of their property, this could get messy in a hurry. I wouldn't be surprised if you start finding you access to your driveway blocked going forward by vehicles and bins etc as these things have a habit of snowballing. You boast you never back down like is something to be proud of. It also can make you sound like a bit of a bully - cocky, arrogant and inflexible. You probably didn't mean to come across like that, but if you did when lots of people encounter someone like that it gets peoples back up and if next door are up for a fight I wouldn't be surprised if that's exactly what you get. Depending on their drawings they may even involve a solicitor and the LA Planning section.

Yes, but the windows on our side are obscured, was part of the planning permission. It was originally a balcony area as those houses have the lounge on the 1st floor (weird idea) and then a balcony above the kitchen. Lots of those type on the estate have done that.

Yes, but the windows on our side are obscured, was part of the planning permission. It was originally a balcony area as those houses have the lounge on the 1st floor (weird idea) and then a balcony above the kitchen. Lots of those type on the estate have done that.

Have you considered calling the duty planning officer for an overall opinion as I suggested earlier?

I can fully understand your neighbours point of view but......

Your land, your drive, your property and it's up to you what you do with it. If you want to put gates up, I can't see how anyone can stop you. If I were you,
I would just fit them. Not to be malicious, just because that's what I wanted to do.

You could actually build a single story extension, right up to her wall and no-one could do anything about it. At the end of the day, the window issue is with her property (and new owners issue) and not yours.

It's not ideal for your neighbours but the fault lies with whoever designed/built the houses. Seeing as they can't even access the windows to clean or maintain them, it suggests your house was designed/built after theirs? Surely nobody would knowingly design it like that?

Really? Well for one, it is not a council estate. And secondly, if it was, what difference would that make? I was born and brought up on a council estate, but I choose to bring up my children elsewhere.

Lots of new houses have issues like this. They don't tend to adapt the designs for specific plots. In our old house our landing window was on the side and faced our neighbours ensuite window. Only separated by the 3 odd foot wide passage way. That and being built so close together. It's one reason we bought an older house when we moved.
