My Number Plate has been cloned

And where this time ....

It could almost become tempting to let it go to court to get your expenses paid.
 
I'm so tempted to do that or take them to small claims.

And yes my Romanian friends.

Really tempted to put on retention for a while and get another plate.
 
Just spoken to the DVLA. If I put the plate on retention I will cause myself more issues as ther fines will still come to me even though they plate will not be on a car.

So I am better off leaving it on as, excuse the pun, but it really is black and white case, where as I will need to prove that it isn't my Van otherwise. :headbang:
 
Is it a police matter as there obviously is a Romanian who is not complying to any laws in the UK?

This. Should be reported to the police.

Also, given the number of foreign vehicles on our roads, the ANPR systems should be supplemented to able to determine a difference in vehicle colour. Either that or a situation such as this should allow for the registration to be flagged on the system for manual intervention. But it's a government system so that's never going to happen...

Problem is it will all be automated and the only thing it will check is the character string. The letter will be generated by matching that with the DVLA records, printed and then just sent. The only human in the process is more than likely the postie.

I would not be at all surprised if they sent someone round to check you didn't have a white van :wink:

The officer looked to see if there was a marker on the plate which there is not. If I want to get anywhere I need to log it with each of the police forces in the areas where the violation took place. I will call Dartford police and see what they say but basically being the lawful party the law is working against me.

There is nothing stopping this Romanian van from coming to and through through Europe as and when. Wasn't so much of an issue when they had physical barriers at Dartford as they had to pay there and then but of course now they don't. :headbang:

What is more annoying it that I can't put the plate on retention as it will make things worse. :headbang:
 
You need to change the title of your thread - it wasn't cloned, it was just registered in another country :evil:
 
Just thought I would ring Dart Charge themselves to see if I could resolve once and for all. Sometimes speaking to a human pays dividends.

I established the following

There are more charges waiting as they have not paid for other crossings. I have no idea how many as they wont tell me. Bloody Data Protection :headbang:

The £5 I paid for the 2 crossings for the Duxford show have not been allocated to my crossings :headbang:

The penalty charge I disputed has been cancelled although I have received no notification from the enforcement agency (not Dart Charge themselves)

Anyway the lady I spoke to was very helpful and hopefully is dealing with it to ensure any crossing with my plate go through image review.

If this doesn't get resolved after this I will issue one more letter with an invoice and then just sit on any further charge notices and they can take me to court.
 
I am seriously fu@ked off now. Another one thorugh my door.

I will be replying to them both with an invoice for £50 enclosed, £25 for each as per my original letter.

Any advice on what I need to put on the invoice from a legal point of view?
