List of problems.. Back from dealership with more problems..

It is indeed shocking service you are getting... I am no expert but I would stop using email from now on. Put every response in a letter and send it so it needs to be signed for. It is much more difficult for them to say they didn't see it, or it slipped through the net etc and also gives the impression you are upping the ante,so to speak.
 
I am sending it direct to the dealership principal and copying in the service manager to all emails. I have delivery receipt turned on but I never get a read receipt from anyone I have emailed at the dealership.

I tried calling yesterday and left a message for him to call me.

You're right Kevin, there is no communication. It's me sending all the emails and letters and making the phone calls. There is minimal effort from their side.
 
Read receipt doesn't always work between different mail systems/domains etc and can be cancelled by the user, so not getting a read receipt may not mean anything.

The weeks just go by dont they, and if you dont keep chasing it, several weeks can go by and nothing happens.

Nothing to stop you trading in the car somewhere else, and the other dealer clearing your finance, but if they ask "Why you changing it so soon", are you going to say "cos its a piece of s**t with loads of problems and the dealer is crap"?

If you say that, they might de-value the car?

if you are serious they may even act on your behalf with BMW to get your car rejected so you can move onto a VAG! :)

Frankly i'd hold off looking at anything else just yet. it clouds judgement. Deal with the issue in hand?

1. Call the dealership, get to speak to your guy Scott or the dealer principal.

2. Arrange a meeting (yes, I know it's a long way). It's the only way to get this done but the look of things.

3. Speak to your solicitor before you go. Get some recommendation of action (to fall back on). - just for you at this point.

4. meet at the dealership face to face, be polite, nice, but firm. propose what you want. - I.e. if it's a new car / one off the lot etc. and agree with them a timescale to resolve (5 days seems reasonable) and what the action is if not resolved (or failure re-occurs).

5. Summarise it in writing there and then (take your laptop). get it printed by them, and signed.

Wait your 5 days.

Otherwise, I fear they this this is a little out of control. Take control. 8)
 
Im not too sure Kevin. I will just tell them that its not living upto expectations etc.... Just not sure whether I will get enough for the car to clear the finance.

I have looked at the SLK AMG sport but its not for me. I think if I was going to go for a Merc I would be looking at the C class AMG sport Coupe. Just dont think im ready for a car that big yet.. Nice looking things though!
 
Seems repair and keep the car, or reject and get a replacement, or reject and walk away are your options.

No point trading in for another car if you cant clear the finance. If you rejected it and walked away, do you get the deposit/payments back?

For me, there is no other car in the BMW range I want, and apart from a Boxster, nothing else either, and I couldn't afford to run a Boxster for work! So I want a replacement Z4.

Agree with the previous post though, need to get things clarified with you and dealer as to where you are etc and what outcomes you expect, or it will just go round in circles.

Have you contacted BMW Finance yet? I would do so, even if you decide not to reject, they can help push dealer into action.

John you gotta meet them face to face or very least get them on the phone, leaving messages and e-mails can be ignored, a face to face is much better, it's what I did when I rejected my new Peugeot and it works much better in your favour but back this up with letters to the dealer and BMW customer service.

Please don't go with Audi there worse than BMW,seriously.

BMW Customer Services will just bounce you to the dealer, but it doesn't hurt to send them the letters anyway.

Its BMW Financial Services who are on your side.

My opinion - tell them all!
 
Just a note about this JDM. I am in a very familiar territory as you at the moment however I have been speaking to BMW financial services after having no joy with BMW UK or BMW Eastern.

Here is the interesting part, your dealership inspects the car and then tells BMW FS about the car. It's not up to the dealer to accept the rejection it's actually BMW FS that decides if they are going to accept the rejection of the car. As soon as I got off the phone with BMW FS stating I had went from resolution to looking for out and out rejection I got a call from the sales manager asking me to phone him along with a text message asking me to phone him. I refuse to speak to my sales department after the way they handled me and then there is the bloody managing director who was extremely rude. I have booked the,car in for the 23rd of August and I am drafting the letter!
 
In my case I sent a letter to BMW Financial Services, BMW UK and haded a copy to my dealer. I put on the letter cc: etc, so they all knew who I'd given it to.

BMW Customer Services wrote back saying I had to go via my dealer.

BMW Financial Services sent the dealer some forms to complete. I spoke to the DP and he said they were to basically clarify the series of events - I'd listed them all in my letter, but I guess they need his confirmation, and also a load of financial details about what the car is worth and the delaer has to make an offer on it.

I said to him I dont see why he has to buy it off me, cos BMW supplied the faulty car, he said he doesn't, but it will be offered to the dealers.

So, I guess they will look at the case, see how much they can get for the current car and then (I suspect) see if this coveres their cost for a new one, cos obviously a new one wont cost them as much as it does the customer. I can see them making a profit on this!!!

I rang the financial services lady on Wednesday and she got the paperwork back from the DP and is now processing it. She said she will do that with BMW UK. So I dont know how long it will take.

I asked for 3 specific things (replace car due to leak, upgrade to auto box due to hill start, refund all finance payments to date due to the hassle). I doubt we'll get them all, but you gotta ask!

Gonna chase her next wednesday, cos that'll be a week round. Would be nice to get a phonecall in between saying they've agreed to things!!!!

If they replace the car, apparently the finance agreement stays the same, they just change the details of the car. But this means I wont have the replacement for 4 years, cos by then I reckon 6 months will have gone. Also, the gfv should be different cos its a newer car, so will have to look into that if it goes through.

I hope you get an outcome you're happy with John. And not to make light of your long list of issues, but I will say that growing older combined with having kids and pets that unwittingly seem able to damage anything I own from 20 feet away (!) has made me much calmer about things not being perfect for more than a nanosecond after I've taken delivery. Sad but true :-)

Probably too late, but the advice to consult a solicitor is sound. If you are thinking of going legal add the phrase "without prejudice" to the top of any and all communications with the dealer. This will stop anything in your communication having a prejudicial affect on any case you may or may not have and send a very clear signal to the recipient you are considering lawyering up. unfortunately too late for anything you may have already sent.

Once you involve a solicitor, leave everything to them. You're an Architect I believe so you'll understand about the "leaving it to the professional".
