Just bought a Z with MOT and brake pad warning light on?

Hi,
A friend of mine picked up a 2.2 yesterday from a used car dealer with a full 12 month MOT just carried out as a condition of purchase. He has done less than 50 miles and the brake pad warning light has come on! My question is if the pads are at the point that it would trigger the warning light then should it of failed the MOT and what are my friens rights?

To my knowledge as long as they stop the car it's a pass. Might have got an advisory and on the new MOT that would be on the front page.

I guess he should have glanced at the pads.

Ok, done a google check and looks like theres no comeback on pad thickness:


BRAKES

Inside the car
Anti-lock braking system (if fitted) Warning lamp is checked for:
• Function.
• Sequence of operation. Footbrake
• Reserve travel on the footbrake so that it does not go down to the floor
• Pedal rubber not worn to excess
• Correct operation of the servo assistance system.

Reserve brake
This could be a handbrake or a footbrake.
Checked for reserve travel so that it does not reach the stops on application.
The mountings will be checked for security and /or corrosion.

Under bonnet checks
• Master cylinder and servo unit are checked for fluid leaks with the engine on and the brakes applied.
• Servo unit will be checked to ensure it is operating correctly.
• Visible metal or flexible brake pipes will be checked for corrosion, condition, breakages or leaks.

Under Vehicle checks
With an assistant applying load to the
footbrake:
• Flexible brake pipes and any other metal brake pipes visible beneath the car are checked
• Disks and drums checked for condition and contamination
• Brake back plates and calliper securing devices are checked for condition and security
• Condition of the brake pads will be checked if visible
• An assistant operates the handbrake while the condition of the linkages and/or cables is checked.
• On some vehicles there will be a brake compensating valve beneath the car which will need to be inspected for fluid leaks

Brake performance check
The performance of the front and rear brakes will be checked for efficiency and balance using specialised equipment.


Have you a right to refund/replacement?
 
Go to quick fit or similar garage get them to do a free brake check if they are low get them to put it in writing and take it to where you got your car from and ask them to fit you new pads or you will take them to court for selling you a car in dangerous condition

Think you'd struggle to legally reject a car for this. You may, however, find the dealer is feeling kindly towards your friend if they are approached in a good manner and asked if they will sort the issue for goodwill. Or at least, a contribution. Let's be honest, a diy-job for under £100 (front and rear) isn't a deal-breaker. The MOT cert is certainly valid, and wasn't obtained nefariously if the wear indication occurred later. The brakes are still, of course, safe and legal. He's just getting his early warning.....
