Insurance Fine?!

Hi all

I have my old 3 series up for sale, and since buying the Zed I cancelled the insurance on this old car (it doesn't even run - probably going to have it scrapped).

I just got a letter from the DVLA saying I have a £100 fine for being uninsured - I have not driven the car since cancelling the insurance.

I was under the impression that to declare SORN you had to physically move the car off the road - its parked on the street outside my house, as I don't have a driveway.

Any suggestions on how I should proceed?

The letter says if I pay up by 2nd Sep the fine is only £50. If I have to suck this up then so be it, but I am not happy at all. I thought the offence was *Driving* while uninsured?

Think if a car is on the road, it has to be insured so you may have to pay up...

I'd guess you'll have to stump up.

Your car isn't SORN'd and is still on the road so would be hard for you to prove that you haven't driven it.

Obviously, once you've paid the fine you'll either have to A) SORN the car (and make any other arrangements to enable it) or B) Insure it.

i thought the only way you can sorn a car is if it is OFF ROAD :?

So by having it park on the roadside you will need to have it insured etc.

Taken from the DVLA site: https://www.gov.uk/register-sorn-statutory-off-road-notification

"When you need to make a SORN
If you don’t use or keep your vehicle on a public road (eg, you keep it in a garage, on a drive or on private land), you don’t have to buy a tax disc. Instead you must make a SORN.

Your vehicle must be in and remain in Great Britain to make a SORN."

Is it just a fine and no points? I thought no insurance was 6 points too

bollocks.

the fact that it is buggered and won't even start makes zero difference I suppose.

I did not know this. :(

The problem is that you won't be able to prove that it has been buggered since the day you cancelled insurance (not that I'm sure it'll make much difference anyway)

agree with the other comments re this - it needs to be insured even if it's a non runner. Thinking logically, you need to ensure the scenario whereby another vehicle (car, bus, truck) collides with your stationary vehicle, which could in turn collide with and/or injure e.g. a cyclist /pedestrian - in which case you have an insurance company to act for you - otherwise you have the potential for others to sue you not your insurance company - so really this insurance is to protect you.

It is sometimes tempting to think that car insurance is just about insuring your car - it really is a bit more than that - hence the number of substantial Personal Injury Claims and settlements and I know some have views that these are not all justified but some most definitely are e.g. drunk / drugged drivers etc.

If this fine is without Points take it quick as it could be much worse - it would be a tad unfortunate to acquire points so act quick !

Fair enough.

I'll chalk it down as one of life's lessons.

As above, now all cars on the road must be insured. It came in last year I believe. Not got a friend with a drive that'll let you stick it there for a few weeks until you sort scrapping it? I'd pay the £50 and get it off the road TBH.

if a vehicles is parked on un adopted land does it need to be insured? i am assuming not

That makes no difference as it is only related to the maintenance element. Just like parking at Tesco - you still need insurance.

They got us all by the balls mate, pay the lesser fine and you may not get any points and swallow it,similar thing happened to me a few years back with an untaxed car,had to take in on the chin.

An uninsured or untaxed car mustn't be parked on the public highway. If it's untaxed then it can be parked on private land but you will need a SORN. This has caught out owners restoring an old car.
It's simple all DVLA are doing is trying to clamp down on uninsured drivers and it makes sense.

You can't have an insured car in your garage unless its declared SORN.
