Got crushed yesterday morning not happy, cars in a bad state

Ouch. I'd be thoroughly pi##ed off if that happened to me.
Hope it all works out for you.

I live near the port of Dover and eurotunnel so we have lorries a plenty, I always stay well clear.

Ouch! That's a sore one. I always let lorries go at roundabouts this is due to the size of the vehicle and the fact they aren't as agile as a car. My instructor always told me to give them space because they will alway cut over the lanes.

Hopefully it can be sorted and you'll be back on the road soon.

Blimey, thats shocking driving from the bin lorry, he needs to go on a driver training course, badly.

Sorry the car is such a mess, but glad to hear that you walked away, that is something I guess.

Where are you based? I've used a body shop called sprint auto repair approved merc audi and bmw repairer. Work is too notch. Sills all look intact, is rear quarter panel damaged? Paint alone would be roughly 180-250 a panel, wheel repair 40-60 a wheel refurb.

well admiral my insurance company are using albany, a sister company. i have been given a 63 plate c220 mercedes as a hire car at a cost of 355 pound a day, which i do not have to pay. I have a friend who works at the same council place and the driver has admitted full liability. The governer/managers have all agreed it was his fault. I have heard nothing from my insurance company regarding, coming to look and assess my vehicle. Probably will be a right off as there is slight damage to the passengers side sill, all wheels will need a refurb, or replacements. What would be an acceptable valuation on my vehicle any ideas? its a 2.5 114kmiles. red leather, sat nav and carver system. bodywork was immaculate, no issues with it at all? heres some more pics of the damage

Albany are Admiral, and they're ripping of the 3rd party insurer's by charging £355/day for a C220. I had a 100 mile old e92 M3 for £350/day. It's a scam they all do, but it only costs us more in the long run as they just increase premiums to pay for the £10k write-off and £10k hire charges.

As I said earlier, be careful you don't have to justify the cost of the 'hire' car to the other party's insurer or judge.

If you've got the details of the other party's insurance, then call them and tell them you've been offered/given the £355/day C220, and they may offer to give you the same vehicle from their own provider - which probably costs them £50/day. No need to force everyone else's premiums up with these exorbitant hire car charges.

prepare to have an absolute pain in the balls with the insurer, i bought my zed after hitting some oil going past the docks in belfast and skidding at about 25mph up a kerb and head on into a 14ft wall in my hyundai coupe (was grand rescued my footy gear, all good)

they got back to me within 2days of the crash saying it was a write off and had offered me £4700 and had posted the cheque already "in case i'd accept it" , your car being immaculate, servicing you've done to it recently, changes you've made mean absolutely nothing, neither will the fact you said "car is valued at £x" when you signed your insurance and it effected your premium.

whatever model/age/miles it is and that came with it as standard is all that matters and how much it will cost to replace it the same model/milage/age for within 70miles of your address basically.

whatever they offer you contest it, and then keep chasing them to hurry up, basically they work on "inconvenience" and offering you around enough that it's less than you want but close enough you will take it on the chin rather than be without a car for #x weeks. (you've a hire car and it was someone elses fault so you're in a better position than most, i had two other cars to use so i was alright in this stage too)

i had to send them 3 examples of models (from traders remember...which is a bonus) of why their evaluation was inaccurate, which i did, sent them three examples local to me of cars with similar age/spec/model at 6k or there abouts, they replied with i s**t you not , two examples, one had a smaller engine and 30k more miles, and one was an automatic and 3 yrs older
got an extra grand in the end.

edit>
oh yeah and if you fitted anything non standard but still have the factory bits, go and rip it out those parts of whatever recovery centre it's in and leave the factory bits and bobs ont he floor (audio equipment or whatever)

As others have said be careful with Albany, they will give you a ridiculous hire car as they can claim the costs back from the other insurance company but if they think your taking the pee you'll get stung. If you've got a second car for example or you can use public transport to get about without it unduly affecting you (you can claim those costs back obviously) then you should use that. Basically your not allowed to be better off than when you were before the accident so it's on you to mitigate your losses. Also don't keep the hire car for any longer than you absolutely need it or until you get your payout whichevers first, otherwise you'll get the same result.

If it gets written off, and I think it will I would be so tempted to buy it back and repair. I reckon it will cost around £1-1.5k to buy it back.

only problem with that is selling it on later, and insuring it as a cat.d writeoff

With fully documented rebuild including photos it shouldn't be an issue. Other option would be to part it out. If it has M sport seats you'd get half your money back straight away.

I would contact the 3rd Party insurance and explain that this is the car you have been given and see what they say, see if they think it is acceptable.

I had an accident 18 months ago, 3rd party fault came out of a side road when I was travelling at 35mph (hit me in my passenger front wing). He admitted liability.

I was exactly like you, told by my insurance company I did not have to pay for the hire costs (my hire cars cost £200/day Honda Type R and then a Mini convertible).
It took 6 months for his insurer to pay for my write-off and it ended up nearly in Court for the hire costs - settled on the morning of the Court hearing. I had to provide all payslips, bank account statements, records of any savings, etc for 3 months before the accident, during the accident and for 3 months afterwards and I had to give sworn statements for Court and answer a full list of 20 questions in a statement of Truth from the 3rd party insurers to be used in court. As you can imagine many sleepness nights over a lot of months due to this.

They claimed (and there is case law to back these up) that if I had the funds to hire a cheap car or even buy a replacement then that is what should have been done and even that savings or loan should be used.

If you have that car for 1 month then that is £10,500 that you will be claiming against the 3rd party insurance - £21,000 for 2 months!

Be warned, if you think that it is your insurers responsibility to claim these back, you are wrong. They court case regarding my hire costs was taken in my name as the claimant. It was not an experience that I would like to repeat.
