I would'nt have high hopes for trading standards being much help after my recent experience with them,their advice is always put your problem in writing first and document all calls. Good luck I hope you get your zed back to the condition when you purchased it.
 
Not looking good. Consumer advice said that from a legal point of view the dealer is under no obligation to foot the repair bill as it is not something that they should realistically have checked. Had it been new, the manufacturer would be responsible, but not the dealer when selling second hand.

This was their point of view however as its apparantly not set in stone on this sort of thing. If i went to court it could go either way. So il speak with the dealer again, try and work something out but i dont have time to spend hours and hours trying to get 150 out of them.

On another note, £104 for the mirror glass from BMW!! Absolute joke! Bought one from eBay, hopefully shall be a decent quality.

Update, guy arrived at my office this morning to do a job on my bosses car covered by paintwork insurance. He said he can fill the chips and polish out all the other scratches and buff it all up nicely, will put it all through as part of bosses job on insurance (doesnt affect my boss in any way) just buy him a beer. So dropped the guy £20 cash and hes working on it as we speak. Also doing another of the guys cars here and refurbing a couple of alloys at £20 a wheel.

Hes having a good day having turned up to do a job paid for by insuance and leaving with £150 cash in his pocket. Also wing mirror glass has turned up, looks identical to the other mirror at 1/10th of the stealer price. So for the sake of £30 i cannot be bothered chasing the dealer to sort this out.
 
Update, looks no better, he gave the cash back and said he couldnt do it properly today. Has put some paint in scratches so protect them but other than that looks standard.
 
Update, sent a strongly worded letter, via recorded delivery, to the dealer. He phoned me this morning, as nice as you like, and asked me to bring the car in and leave it with him for a couple of days and he will have it resprayed for me.

Had some bits of info from the Consumer Advice Bureau and Trading Standards in there and it worked a dream. Im thinking him being an ar*e to start with was purely an attempt at deflecting me away, but he knew he would probably have to get it sorted. So fingers crossed they do a good job and my Zed will be back to its beautiful self quickly. 8)
 
From a legal standpoint, I really can't see how this would be the dealers fault. It could have been banged by you or someone else, weakened by a power washer, any number of potential reasons. In my book, it's simply one of those things.

However, if the dealer is willing to foot the bill following a well written letter, then that's great news. :thumbsup:

Mab, basically the sale of goods act states that any fault found with a second hand car is assumed to have been present at the time of sale unless the dealer can prove, without any doubt, that it was caused by the purchaser after sale. I was surprised when i received this information from the citizens advice, but i will not be complaining. Its also out there now for anyone else who has similar problems. if anyone wants a copy of the email with all the info i used from the sale of goods act and other places drop me a pm with your email and il forward it on. Could come in very useful considering it covers you for 6 months!! :thumbsup:

Pleased it's getting sorted.

A word of caution on the SOG 6 month thing though. Although you are covered for 6 months, the car still only has to be in reasonable condition.

E.g. if you buy a £1000 snotter from a dealer and the air con breaks after 3 months, they're unlikely to be obliged to fix it. To test the theory you would need to take them to court and persuade a judge that the air con breaking on a £1000 used car is not reasonable. Not an easy task. Now if the engine failed completely 3 weeks after buying it then that may be a different matter.

Basically the law is really a grey area on this subject!

On the other hand, I think you have a stronger case that although your car is second hand, it is still not reasonable to expect bits to drop off it so soon after buying it! Pleased that it sounds like you won't need to test it in court though. :D
