Couldnt be more annoyed!

Just popped out from work to get some lunch. Driving down the a14 at 70mph-ish, wing mirror glass fell out of drivers side mirror and shattered on rear panel by the filler cap. Screwed the paint good and proper, a 6 inch square area covered in small chips right down to the metal.

Not happy!! Only had car for 3 weeks, but no doubt the 3 month 'warranty' the car came with wont cover such a mishap. Not the start to the weekend i was looking for, especially after spending 5 hours cleaning the fucker last Sunday!!!! :headbang:
 
Very unlucky indeed!! This has happended to other people in the past, but not where its hit the car and wrecked the paint...
 
Straight to the dealer mate... by law you have 6 months where there car has to be good and proper and for it to happen after just 3 weeks then I would have them sort it at their cost...

What a nightmare :(

I would have try a warranty claim - a good dealer might repair it free of charge. However, suspect the dealer will claim wear and tear and thus no liability.
 
it is common for the wing mirror to fall off - both mine did - drivers side as I was pulling away so now body damage... passenger side fell off in my hand when I tested it when fitting the new one to the drivers side...

as peddy suggested, take to dealer and complain - certainly can't hurt!
 
What a coincidence i drove over our pot hole riddled roads and saw the mirror shaking badly pulled up and upon touching the glass it fell out and luckily caught it.

Should i glue it back on or use some sticky pads?
 
Just been down to take some photos and properly check it all out as was too pi**ed off earlier. There is a scuff, then a chip on the door, then 2-3 chips and then the spot where its shattered. It really has ruined the full side of the car. Am putting together an email with photo evidence and then going to phone the dealer. The dealer is 90 odd miles from me so i dont want to just drive down there and then have to have an argument to be told they wont do anything. Plus i will stay calmer on the phone than face to face.

Also i dont really want them to do the painting as they will use the same body shop that did the bumper, and while it has improved, thats still not totally right i dont think. But most people cant tell, think im just a little OCD about it.
 
This is not going to end well. basically i bought the car from Dealer 1 who is the son of Dealer 2. Dealer 1 sells his own cars, along with some of Dealer 2's cars. I phoned dealer 1, he says the car was dealer 2's so my contract, and therefore any dispute is with dealer 2. I phone dealer 2, he says "what you calling me for, you bought it from dealer 1, give him a call."

Ive checked the receipt and it has all of dealer 1's information on so he is obviously the one i have the contract and any dispute with. I will now spend the next hour calming down.

Not had a dispute like this before and the guy is obvioulsy going to be a nightmare to deal with so what should i go in armed with in order to get the best results here. any help would be gratefully received. :thumbsup:
 
J P S in Peterboro. To be honest i dont know if i actually have a leg to stand on in this dispute. Am i entitled to a free repair? Could this have been forseen and prevented? Its not a mechanical failure, it doesnt make the car dangerous to drive, apart from the lack of a mirror at the moment.

Is this how you see it, is it purely down to whether they are nice enough to do it for me or do you think i should be pissed about it and kick up a fuss?

Nothing like passing the buck between the two is there :roll:

Surely this has to be covered under warranty. Easy for me to say, but i would DEMAND the repair be done free of charge! :x
 
I will be demanding, but at the end of the day if there is no legal obligation for it to be done then they are well within their right to just say no and then there is nothing i can do. Il wait to hear back from consumer advice and il give them a call again tomorrow when im not so worked up.

A chip repaire company (not chipsaway) are coming into work to do my bosses car on Tuesday so if i havent got anything sorted by then il see what price they will give me to do it then. Might have a few other chips sorted at the same time if it comes to that.
 
Real sorry to hear this but to be honest by the reaction you have already had from the dealer i dont think you will have much joy, they will come up with all sorts of excuses, i bet they will say you have knocked the mirror at some time so its your fault, you could chase them through small claims court but could end up costing you rather than him.
Also, i dont think i would want him repairing my car not with the attitude he has shown you so far.
Push him by all means and if he does offer to do the repair just find out who is doing the work and give em the once over first.

I think the dealer is pretty much blameless unless they changed the mirror. I don't check for loose mirrors and would expect a power wash to shift it when the car is being cleaned, not when I was driving along. I have never seen it on a 101 point pre-sale check. Have you?

V V Annoying but one of those things I guess.

Bit frightening really-could happen to any of us,do people recommend trying to loosen/pull theirs off with reason being to attach them more securely?(as bmw's adhesive cant be up to much' all the posts i have read about it on here) :cry:
 
BSEZ4, did you completely miss my post?? you have the law on your side!! You purchased a product which has failed after only 3 weeks!! of course you have a leg to stand on... you have many!! If they kick up a fuss then report them to the trading standards...
