Complaint for speeding in 30mph area on Kent run...

I'll let you know if I get one too....don't think we were speeding at that point, not that we did anywhere else :driving:

I am not sure how this data could be used and how qualified these people are. I realise they are trying to do the right thing but I would not be happy about this either as Jembo was obviously not speeding at the time.
They are also using or have access to data bases to identify names and addresses which is also concerning.

Agree it's concerning the data they have access to - unless the reg is given to the police who then send the letter ? And if they don't send it, do the police supply the name and address to the Rinses ? Not sure how Joe Public can get access to that info - I don't think I can.

Understand the concern with the car allegedly being marked with a caution on the police database for 'anti-social driving' - strange that it would be formal without a visit from said rozzers though. Off to google the document Adamski posted now, sounds interesting...
 
Trust me it's BS. There is no such offence as antisocial driving. The readings taken by the Community Speed Watch have no validity in law and cannot be used in evidence for speeding or taken in to consideration when considering a prosecution for speeding in the future. They are trained and authorised by the Police to trap speeders then the Police send out the BS scare letters. You only have a problem if it's a letter from the Police to the registered keeper with a "Notice of Intended Prosecution" and demand for driver details. If not I'd just forget it :thumbsup:
 
There is such a thing as anti social driving, that is the S59. But that can only be given by police when they whitness it I though

Err that was my point, I was, I know I was & had at the time 8 or so Zed's behind relying on me I was...
I was 2 Zeds behind Jembo at point that point, (we turned right just after) there was no speeding at all as it was residential. Just so you know, I haven't received anything.

Jem, I think I was behind you and definitely saw the florescent clad numpties playing silly buggers in the road. I'm off to my folks house tomorrow (where my mail goes) so will let you know if I get one.

I think they will just send a snooty letter out. They have no power.

My brother got hit with a S59 on his bike, but the officer who stopped him went to his place of work 3 times and tried to get him to sign it after he was let go with a warning and nothing else. She then followed him from work to home and collared him outside the house. In the end my father had to go down and threaten with harassment before she conceded that she had let him off.
 
Just downloaded Gloucestershire Police's document about CSW (Community Speed Watch) and most counties have one. Pertinent info:

Offending drivers’ vehicle details are recorded on a timed, dated and signed csW activity Log sheet. completed sheets are forwarded to your Local policing team, who will arrange for letters to be sent out in accordance with the availability of administrative support but the constabulary will endeavour to contact as many offending drivers as possible

A maximum of three letters will be sent to the same registered keeper. after this, the vehicle details will be circulated for targeted police intervention with a view to prosecution.

So the police send the letters, which are purely a warning. Once you've had a few you'll be actively targeted.

PVR is right there is the s59 which is basically a driving asbo... Where of you get more then 3 offences you get fined.

But this sounds totally different.

I did see them and thought what's that all about.....

A couple of ideas

1. Data protection act

Under the data protection act any one holding data linked to an individual have a duty to ensure that it is accurate. You could write to the data protection officer, at the address the letter is from, complaining that the data is inaccurate and you have GPS and video evidence to show that and asking for your details to be removed from the database along with anyone else 'caught' the same day. It only needs one invalid result.

What I don't know is if this data has an exemption under the act like some criminal databases do.

2. The complementary complaint letter.

You could write to the community speed watch team and the police stating how you thoroughly support the intentions of the community speed team and go on to say that in order to ensure the public support them and not to see them as 'vigilantes' it is important they and thier equipment are accurate or the public will lose confidence. Then go on to state that you have video and GPS information they shows on this occasion something went wrong and request this is investigated so that this excellent work can continue without compliant in the future.
 
3. Local press

If you can prove you were under speed limit then local press would probably love to run the story / investigate further.
 
I saw them, when i drove past they were chatting to each other, but I was definitely within the 30mph limit. Its a community action thing, they have no legal power and cannot bring any conviction against you. I think it tends to be locals asking for a speed camera, and police saying you can't have one - but you can do this:

I do remember the bloke with clipboard not having a vis vest though, doubt it has any impact.
 
As mentioned before...COMMUNITY SPEED WATCH... usually your local council type busy bodies. They buy the kit themselves, it should be calibrated but generally is not.

The letter isnt worth the stamp, ignore it and ignore the targeted bit its a ruse to make you worried. Perhaps if you had lots you may become an intelligence target, but for minor infringements I doubt it. You may get a visit from the local community cops to have a word in your shell like.

The vehicle ASBO is a different matter. Generally cops will witness an offence, wheel spins (being a complete nob), low level street racing from lights, doughnuts etc and you get an ASBO warning against the car or driver. IT stays live for 12 months on PNC and if you get another then your car is seized. £150 to get it back. This is a good tool for the boy racer Corsa crew. Complaints can also come in corroborated by 2 members of the public which could also be investigated and ASBO invoked.

Community Speed Watch runs only in a few areas of Scotland and lots in England/ Wales. Scotland is under review due to the calibration, training, risk elements and may well stop.

Having used ASBOs they are a great tool when used correctly for vehicles and the Friday/Saturday night crew.

Community Speed Watch can be a good deterrent for the moral majority, but for the enlightened its no great shakes.
 
What a steaming load of f"cking sh1te. It seems our Police force are hell bent on p1ssing away every last scrap of respect they may be clinging on to from your average hard working tax paying law abiding citizen. For the avoidance of doubt that means me too! :thumbsdown:
 
I remember seeing those fecking do gooding old biddies, lucky if we were doing 30 when we went past let alone any higher
 
People with nothing better to do with their time.

Would be a better use of their time to give it to those in need of an ear.
