I make it a rule never to under take anyone for the simple reason being that i dont want points on my licence with it still being illegal in this country.

I was informed by a road traffic officer that as long as you don't weave in and out of traffic, undertaking isn't necessarily illegal and is sometimes necessary. I have to admit doing it occasionally when there is a hard shoulder (not the weaving part), on my journey home on a Thursday night the M1/M18/M62 are generally quiet but still people insist on driving in the middle lane when the inside is clear :headbang:

Anybody else got a legal position on the undertaking front

From the Highway Code:

Do not overtake on the left or move to a lane on your left to overtake. In congested conditions, where adjacent lanes of traffic are moving at similar speeds, traffic in left-hand lanes may sometimes be moving faster than traffic to the right. In these conditions you may keep up with the traffic in your lane even if this means passing traffic in the lane to your right. Do not weave in and out of lanes to overtake.
