I heard on hear today that its 96mph so you might be ok?

It's 20mph over the maximum road speed, so understand automatically means a court appearance. If it was near an exit ramp & you were overtaking traffic, the Highway code does state & allow you to overtake as quickly as possible (it specifically does not say you have to overtake within the speed limit) & you could try an argument of you had to momentarily 'overtake' as your exit would otherwise have been blocked...

Yes, but what did it say? Was it a Notice Of Intention to Prosecute (NIP) or a Fixed Penalty Notice (FPN)?ap123ap said:

I was doing 96 in a 60 when caught.... I still reckon by entrapment, but at £60 and 3 points I let it go.... Kept my FPN as a little keepsake....

You should be offered a Fixed Penalty Ticket as it is 1mph below the threshold of 96 as stated above...(it is actually 26mph above the limit)
the fines are now 'means tested' in Scotland anyway.... so the more you earn the more you get fined...
So, scumbag, sit at home all watching Jermey Kyle gets caught and will get a £20 fine, but if you are honest, hard working and out doing a shift, you could get fined £100/200/300 etc...

of course, they have no legal right to check up on what you out on the form, so you *could* decide what you are going to show...

Got caught doing 88mph in a 60mph (very wide non-dual carriageway 4 lane road), got me 3pt & £60 fine - although I was pulled over at the time and the TrafPol did state he would put the speed down as just under the summons threshold of 86mph) as I'd only hit that speed for a second or two whilst overtaking.

I don't have a problem with that at all, you take the risk of speeding, you have to be prepared for the consequences. Just two observations :
1. The kind of person you describe is unlikely to own a car capable of doing 95mph and/or be able to tax and insure it. Therefore if they get caught doing this speed, they would have a lot more to worry about than a fine and points.
2. Strange to take moral high ground, and then to suggest cheating the system .....
We can agree to disagree then... to me the crime is the crime and you should not be "charged" more because you have worked hard to better your life.
It's nothing more than revenue collection and zero to do with the crime.
This doesn't just apply to speeding, and not just at those speeds... even a 20 year old BMW can still do over 100mph anyway, so your point about the car, is well rubbish. :wink:
I have suggested no such thing as to cheat anything, I mearly pointed out that they can't check anything you put down - passing on information.

I think all fines should be means tested.
Let's face it if you are living on the breadline, struggling to pay bills etc, a £60 fine could be a very harsh punishment, whereas your city slicker/ yuppy who gets a £60 fine isn't going to have been "punished" at all.
Carlos Tevez, for example, was recently fined £1000 for his driving offence (uninsured and suspended license)....what's £1000 for him, probably doesn't even register as pocket change. If you are going to impose a monetary punishment it should act as a both a punishment and a disincentive to re-offend. To most, the fines for driving offences (especially more severe offences) often have a relatively large impact on cash flow. The punishment should have the same "impact" on everybody.
