Build problem....thoughts

I have been reading this thread for a few days and trying to work out what the contractual liability is. This is my conclusion:

From the sounds of it they have confirmed written order from you for a car with the cognac interior and you have paid a grand deposit. Some time later you had a conversation with the sales guy about possibly changing your mind about the interior colour and the sales guy said he would contact you in a few days but didn't. The car has now been built according to your original order.

Although the sales guy said he would contact you in a few days to give you lock down date but failed to do so I don't believe this forms any part of the contract. Had you written to them informing them not to go ahead until they confirmed the lock down date and you gave them a final build spec then I think it would be a different matter.

Now in this instance I think it really is up to the goodwill of the dealer to say ok no problem if you don't like when it arrives we will build you another. Personally I agree with what you say they could stick it in the showroom and they will sell it, I don't think black with cognac will be that hard to sell, if it was something like purple exterior with orange interior that might be different.

Good post Silverstar, I’m trying to remember if I signed a further contract with Porsche for the final build spec before lockdown or it was verbal. Surely if lockdown is verbal only it would be easy for anyone to get out of a car they no longer want, I’d think you’d have to have it signed off no...?

When I ordered my F20 here in Spain I received no lock down date verbal or written, I just had the original order sheet with the spec I ordered and a receipt for the deposit. I doubt very much the build date forms part of the contract.

That’s what I found too Greg, on the ball all the way, no guesswork, no thinking for them, they were clockwork.

4 months after taking delivery cracking was found on the tyres. A 5 min chat with them and they agreed to replace them all.

Nearly right Gaz. I presume they had a build slot in mind, however as I’ve said this wasn’t to be rubber stamped until I’d had the test car. Again it’ll repeat myself....sales guy said he would give me a lockdown date when I dropped the demo car off because we both looked at his company car which was parked right next to where I dropped the demo car off and we both commented how good the red looked in certain lights and I said I liked it enough to perhaps have it instead of Cognac. That date never came despite us agreeing he would ring me 3 days after demo hand in so I could pop in to finalise spec. That to me is their doing not mine, and unless he’s going to lie through his teeth that’s what he’s going to have to say to his bosses.

What is amazing is that neither of you knew a build date after signing up for it.. I thought that came on the order form.


The reason that they dont want a spec heavy car with an arsehole coloured trim in the showroom is not hard to understand,it will be difficult to sell..

They want to move units and oddly coloured trim cuts the market down massively,when you think that there is only a handful of people wanting an M40i,and then the odds goes longer with an odd trim colour.

Black,red or silverstone (?) is the common ones that people would "accept".........Brown on the other hand ...

The build date is separate to the lockdown date due to the factory needing to order engines, interiors, wiring looms, wheels tyres, etc, etc, quite a bit in advance of the actual build. This can be amended up to a point, lockdown, as the suppliers of such parts will carry some stock. Final build code is approx 1 week prior to actual build if I remember correctly. I have no idea why I should know the build date from only the initial conversation and deal agreement in the dealer showroom, if I have to know such things and keep my eye on the dealers to make sure they don’t f**k up then I’d expect a payment for my services agreed in advance, but I thought that’s their job as I’m a paying customer and they’re selling the cars. Do you expect your transmission customers to keep an eye on you in case you forget to order a lay shaft or do you tell them it’ll hopefully be done on such and such and you’ll let them know when it’s ready and take payment...? :?
