Build problem....thoughts

Sounds like a done deal to me John , id struggle to believe any sales guy with just £1k deposit banked would press on & order a £50k car just guessing whether you would want a heated steering wheel or not :oops:

Deposit was paid about 5 weeks ago I think Gaz. The deal was this: If I paid a £1k deposit on agreement of the deal on a new car to my spec which we discussed, after a week in a demo car if I didn’t like it they would refund the deposit and I’d walk away. After the test I said I’m good to go once we’d had a meeting to finalise the spec which was supposed to be after the sales guy had two days off and he would ring me to say what time to pop in on last Thursday. He never rang. He said he rang end of the week but that’s rubbish, I never got a missed call form him. I got a missed call from them this last Monday which a didn't hear as I was in bed being badly bu there was No voice msg on it, just a number which i recognised as the dealer, no email or text anything to back it up.

You went in, ticked the boxes you wanted and paid the depo , had the demo for a week

Customer dithers for a bit but doesn’t get in touch to confirm any changes as order deadline approaches

Salesman orders car to customers spec from the details he has...maybe legally he has to order it, you have given deposit and spec so all good , what potentially could happen if he didn’t order it???

I don’t think you will have an issue rejecting the car, I’m pretty sure they are more than entitled to keep your deposit .. perhaps they will or won’t ..

If I was the salesman I would give you the grand to f**k off and don’t come mithering me again :rofl: :rofl:

Again it’ll repeat myself....sales guy said he would give me a lockdown date when I dropped the demo car off because we both looked at his company car which was parked right next to where I dropped the demo car off and we both commented how good the red looked in certain lights and I said I liked it enough to perhaps have it instead of Cognac. That date never came despite us agreeing he would ring me 3 days after demo hand in so I could pop in to finalise spec. That to me is their doing not mine, and unless he’s going to lie through his teeth that’s what he’s going to have to say to his bosses.

I’ve no idea what they’d do if they got a stroppy customer because I’ve been as laid back and pleasant as it gets with him.
 
So, suppose the salesman bends the truth enough (if he feels his commission or job are at stake) that they decide to try to keep your deposit. What then? If you already decided you want a different colour / spec and they're playing hardball you're hardly going to want to reorder through them surely?
The fact you got such a rapid build slot suggests they aren't snowed under with orders so its unlikely the dealer is on restricted allocation. I doubt very much that losing a £50K sale for the sake of a £1K deposit is an attractive option to either the salesman or the dealership. I think if you let them know you'll go through another dealer if you have to start again without your deposit, they might see things differently.

Well exactly Colin, which is why I want all my options now before then car rolls up in the showroom. No way would I reorder with them. The build time suggests the production line is on a one shift day and with many many slots available as you say. I also don’t see why they can’t just put it in the showroom and sell it for the same or more than I’ve agreed.

I’ve already said it’s a first world problem and losing a grand isn’t going to kill anything but who wants to chuck a grand at BMW when it’s the sales guys chuff up, not mine as far as I’m concerned, and nothing I’ve read so far here changes my mind. When I specced the 718 I realised I’d forgotten lane departure a few days after lockdown, I rang the dealer just on the off chance but I knew it was pretty unlikely, can’t do it John, boats sailed he told me, but that was me, I knew when lockdown was so no issues whatsoever, my mistake. This is different altogether.
 
3 days now since i sent an email saying that if it’s built as per emails I’m getting from the factory then we have a problem, they kept saying don’t worry it’ll be fine you’ll love it, I said and if I don’t want the cognac when the car turns up they keep it and build me another since I haven’t had a lockdown date yes...??

No answer to that question now for 3 days. Hardly on the ball and efficient are they.....3 days of silence. :roll:

What is amazing is that neither of you knew a build date after signing up for it.. I thought that came on the order form.


The reason that they dont want a spec heavy car with an arsehole coloured trim in the showroom is not hard to understand,it will be difficult to sell..

They want to move units and oddly coloured trim cuts the market down massively,when you think that there is only a handful of people wanting an M40i,and then the odds goes longer with an odd trim colour.

Black,red or silverstone (?) is the common ones that people would "accept".........Brown on the other hand ...
 
I would imagine that this will not be the first time this will have happened to them or any other dealer. They will have a protocol to follow whether or not to hold you to your contract or not. It will probably depend on whether they see you as a worthwhile customer who may buy another car in the future. They probably have people every other week making excuses to get out of buying the car they ordered.

Have you decided yet what you actually want? Further up the thread you have said cognac is fine.
The conversation you had with the salesman about his red interior could be seen as just chatting and nothing was official. Just like talking to someone about their car saying you liked the colour but in your head saying that you wouldnt ever want it.
 
Easiest solution would be move home, change your name, get a new passport and new bank accounts.

The build date is separate to the lockdown date due to the factory needing to order engines, interiors, wiring looms, wheels tyres, etc, etc, quite a bit in advance of the actual build. This can be amended up to a point, lockdown, as the suppliers of such parts will carry some stock. Final build code is approx 1 week prior to actual build if I remember correctly. I have no idea why I should know the build date from only the initial conversation and deal agreement in the dealer showroom, if I have to know such things and keep my eye on the dealers to make sure they don’t f**k up then I’d expect a payment for my services agreed in advance, but I thought that’s their job as I’m a paying customer and they’re selling the cars. Do you expect your transmission customers to keep an eye on you in case you forget to order a lay shaft or do you tell them it’ll hopefully be done on such and such and you’ll let them know when it’s ready and take payment...? :?

Your 35is was arsehole brown too or very near to it......walnut...cognac...it’s all the same poop.... :poke:

That’s what I found too Greg, on the ball all the way, no guesswork, no thinking for them, they were clockwork. I actually decide to add lane change assist 2 days after lockdown, I thought it was a forlorn request but if you don’t ask....yep sorry John you can’t have it, no issues at all, I still bought the car, it was completely my mistake.

I have been reading this thread for a few days and trying to work out what the contractual liability is. This is my conclusion:

From the sounds of it they have confirmed written order from you for a car with the cognac interior and you have paid a grand deposit. Some time later you had a conversation with the sales guy about possibly changing your mind about the interior colour and the sales guy said he would contact you in a few days but didn't. The car has now been built according to your original order.

Although the sales guy said he would contact you in a few days to give you lock down date but failed to do so I don't believe this forms any part of the contract. Had you written to them informing them not to go ahead until they confirmed the lock down date and you gave them a final build spec then I think it would be a different matter.

Now in this instance I think it really is up to the goodwill of the dealer to say ok no problem if you don't like when it arrives we will build you another. Personally I agree with what you say they could stick it in the showroom and they will sell it, I don't think black with cognac will be that hard to sell, if it was something like purple exterior with orange interior that might be different.
