An un-insured driver wrote off my car INS PRICE UPDATE

Really sorry to hear this. I had a similar event earlier this year in my 5 touring but was driving when I was hit by an uninsured driver. You may still have some joy by going through the MIB ( motor insurers bureau ). You can call them to discuss.

Your PP can now be retended for £80 for 10 years.

Your insurers should advise you on both matters.
 
It is ridiculous that the Police haven't jumped all over this. What if he had killed a child or left someone with life changing injuries?

I believe that driving without insurance should carry a prison sentence, unless you can demonstrate that you had insurance and it had elapsed etc as a mitigating circumstance.

The EU lot are coming over here and not even bothering to get cover. I would get the book thrown at me if I drove without insurance as I am an easy target, traceable etc. The system is a joke.

Unfortunately if no one is injured the police really dont care.

The wife got a Qashqai in Aug, as we had our first child in Oct. This happened in Sept:

She had an (insured) driver go into the side of her when she was 40 weeks pregnant... Not serious but she was shaken up... Police were not interested then either... Just asked if she needed an ambulance!
 
As everyone has said so sorry for you, as for the insurance company, always happy to take the money but weasel out on paying back, I had Classicline do it to me and my 911 a few years ago, they have us by the short and curlies I'm afraid :wkr:

Like others said maybe worth buying it back. Would be interested in the b12 kit if it's not knackered.
 
I've been there, you have my sympathy! Battle the insurers with everything you have got. Prepare as much as you can in the way of proof that the car is worth a lot more than they are offering. You may be right that they will only offer £3500 but I bet a prolonged and well structured argument could get another £600-£700 on top of that. When it happened to me (not with Z4), it took 3 weeks of refusal, and several letters back and forth, from the insurers before they finally agreed to my figure which was 25% higher than theirs. May not always work but worth fighting for. Good luck.
 
You may not have felt any injuries at the time but whiplash sometimes rears its ugly head and may put a different outlook on your position.Good luck.
 
Bit of an update,

I have now put the plate on retention via DVLA online system which was very easy and quick to be honest.

The car is still yet to be collected by the salvage company, so I am still waiting for my insurance company to decide and how much they are willing to pay me for the car, im hoping it will be soon as i'm still car less :(

I have looked on AT, Pistonheads and eBay etc and it seems that the going rate for these is around £4000-£5000 so I have asked for that plus the mods which I have some cover for, not sure if I will get that but that's what I have asked for!

I will loose my excess still due to him not having insurance so minus £350 from those figures.

Fingers crossed all goes well, either the money your asking for, or buy back to repair!

I know there's a few parts I would be interested in, as well as several others but won't put any 1st dibs etc down now as its poor form. Would much rather u could buy back and repair and the breaking option as an absolute last resort, keep us updated and fingers firmly crossed for you and your Z!
 
Any advice on how to get the insurers to pay more?

I'm with admiral and currently have a fight on my hands which they are refusing to budge on!

I am at there 3rd offer now which still isn't enough for me to replace it like for like.

The offers so far are:

£2900
£3200
£3680

I will loose my excess (£350) on these prices but will get back 10% of car value on top for the Mods. For example on the Bottom price I would get £3680-£350+£368=£3698

The car is worth £920 as salvage apparently.

Any help would be great.

Also on other news, police have responded and will 100% not be chasing the un-insured guy :(

They will not get a brass cent out of him. Not worth their while.
Surely, the police aren't there to recoup money but to uphold the law? What's not getting money out of him got to do with it?

Guidelines on a case like this no chance of getting the fines etc then forget it
 
I would initially kick up a huge stink with the particular forces Professional Standards Branch. At the end of the day its not really some low level traffic officers decision what should and shouldn't be prosecuted, its a CPS decision and if they haven't referred it to them i would claim that to be negligence on the polices part. At the end of the day Police Officers are human like anyone else and plenty of them are lazy and looking for an easy life so will just put this in the "too hard" bracket and hope it goes away. If PSB try to give you the bums rush go to the IPCC and make sure when you complain to PSB they know you will go to the IPCC so they know if its not dealt with properly your going to be a giant pain in the arse. Lithuania is in the EU which does give them more options than say a driver from a non EU country. Plus I believe UK insurance gives EU cover as standard and if this is a pan EU recipricol agreement his lithunia poliy should cover him automatically, assuming he had one and if he didn't he should face the same consequences as everyone else. If all this fails i would go after him personally (through the courts, not with a baseball bat!) make his life as miserable as hes made yours!
