Maybe the transmission remains locked at some other point in the mechanism if this has happened, even if you depress the clutch ? A safety mechanism perhaps ? I reckon it's slipped on the handbrake and that's what's causing it. Don't forget that the hand takes on these cars are famously shite - lots of people have complained about it on here, and my handbrake needs to be pulled much higher than makes me comfortable to even start to hold the car... Must get it looked at when I have the next service done.
I'd say there is torque being applied to the gears through the propshaft and rear diff and a draggy clutch. Try releasing the hand brake as the first course of action while applying the foot brake then ease off the foot brake and see if that might release the torque from the gear set prior to starting. That coupled with even a little clutch drag just might be the issue. When you park up. Put the car in neutral while holding the foot brake, Apply the hand brake, Then put it in gear.
I have had that happen in my big 18 wheeler. In fact there is enough torque that if I was even going up or down a slight hill (while driving). I could pull as hard as I could and the gear stick wouldn't budge unless I used the clutch (which is something that you do not do in a large lorry). But if I gave it a little throttle it would release the torque and change to the next gear.

No that doesn't affect it. Mine has hill start and if the car is held on the transmission it realeases as soon as I press the clutch. It does sound like your clutch may be dragging slightly. Why not get an indy to have a quick look? I would definitely be interested to hear their opinion.andysat said:
that's not true, not in practice anyway, mines a 2006 z4m with a shite handbrake. Is always parked on a steep hill and I lock the transmission in gear and you can't get it out of gear until the clutch is pressed before I start the car. Also I've never had your problem in any manual car or any of the vans I move about at work that are parked on an incline locked in gear.andysat said:

I'm saying I will purposefully lock mine, forget the handbrake and hill assist imagine they are both off, I pull up on a hill put the car in 1st and turn the engine off, then release the clutch then foot brake. The car is now locked on the transmission and you can't pull the gearstick, it is locked. This is normal, when I press the clutch the gearstick is released and I can now select any gear I choose without starting the car. Am i right in thinking your car will not release the gearstick when you press the clutch, until you start the car?

I will replace mine when I can afford them, the discs atleast, they aren't worn badly but don't look pretty due to being sat a while, but they irritate me lol. My handbrake works ok its just it doesn't start biting until half way up. So by the time its biting it's running out of travel.
