The overall condition looks consistent with low mileage, especially wear and tear on the leather M sport seats (there's hardly any) - but it just doesn't look like it's had any care taken with it. Maybe groomed for sale (but nothing done to engine bay). The brake caliper in the close up of the wheel is nasty looking, looks like it's been outside in the rain/salt - perhaps that's why the wheels have been refurbished? Also, if it has been outside a lot in the weather, I would take with a grain of salt anything said about the condition of the soft top motor. Unless you can get a camera down there and confirm it's clean and dry, I'd just plan on replacing it sometime in the future.
My 2008 2.5si has the black rocker cover, so yeah, seems to be luck of the draw.
If all the 'defects' are cosmetic, it may just need a good service (all oils/fluids etc) and thorough clean up. Always hard to tell from photos.
Bottom line, if in doubt, maybe look elsewhere - it won't be the only one for sale.
Edit - and of course, grab the last 7 digits of the VIN and thrown them into the BMW VIN decoder to see all the options it came with (as someone mentioned above).
Might be better if it doesn't have upgraded stereo as at least then there's an option to go with aftermarket (when your daughter says "I can't get my music to play off my phone, why's that?....")
