It was Staffordshire and on their web site it says that this has been previously reported so they are bang to rights. Either they pay up or my costs for a morning or so at court will double the cost of the wheel and tyre!

. We moved from Staffordshire to Shropshire and I would say the potholes are just as bad as they are everywhere unless you live near a local councilor :wink:

Just a quick update. Failed the first hurdle as I couldn't supply an MOT certificate on my 12 month old car. A suggestion that they peruse the Road Traffic Act 1988, Section 47 put that to bed. Methinks the obstacles will get more difficult as I go on.........

Funnily enough potholes were discussed on Breakfast TV this morning. Loads of comments of course but the one that I noticed was the motorist who was told he couldn't claim as the pothole had not previously been reported and therefore the council weren't aware of it, so couldn't assess it.
So he reported it. A while later his friend hit the same one. His claim was rejected as the council had been made aware of it and painted a white circle round it, so he should have been more vigilant and avoided it.

It's all about the council being negligent. If they are told about a pothole they should do two things.
1. Decide is the report and location one that warrants an urgent visit. They have to err on caution on this as they have been told about something that possibly could cause damage to a vehicle or serious injury (especially to a cyclist or motorcyclist). There is no reason why councils should not have a dedicated person to look at every report. Only in exceptional circumstances where there is clearly limited risk e.g. in a layby, should they not take prompt action.
2. They then, after a quick visual, need to take appropriate action. It could be nothing to do for now, warning signs, urgent repair or even a road closure.
White circles and being made aware does not allow councils to be absolved of blame for negligence.
