Quite probably yes

From the consumer direct website, amongst other things:

"When buying from a dealer, the law says a car must be:
• Of satisfactory quality. It must meet the standard a reasonable person would regard as acceptable, bearing in mind the way it was described, how much it cost, the age and the mileage on the vehicle. Amongst other things, this covers the appearance and finish of the car, its safety and its durability. The car must be free from defects, except when they were pointed out to you by the seller."

You could quite easily argue that the repair clearly was not of satisfactory quality. in the same way you wouldn't expect a wheel to fall off after a couple of months

Therefore, as i said they must repair/replace/refund.

As i said, phone consumer direct!!!!! they are experts in this and will tell you exactly what your rights are!!

ok final update Synter refuse to have the seat recovered , they say re colonising the leather "properly this time " is sufficient as it is a second hand car he has moved his price of the M so im test driving it sunday if i like it i drive away in that as he buys mine back off me for what i bought it for BMW Customer services head office response - nothing to do with us really you should take up any issues with the dealer we sympathise with you but are unwilling to become involved ! Whats the point of them ? In other words they have no control over their dealers ! Anyway if i like the M i get that if not the seat is re repaired and alloys refurbed so thats where i ended up he did offer to buy back the car for 18k so meant i would have lost 2k in 2 months ! not really an option !
thanks everyone for your support and advice it just seems you dont really have much say against a big dealer like Synter

I caved in and bought the M i havent stopped grinning oh my god the noise :driving: ! the salesman was excellent even gave me a load of supaguard/bmw cleaning products and some hifi gear much better experience this time round i know some will think i should have pushed but bmw customer services head office expressed no interest in helping me with the dealer and to be honest the M is awesome and has washed the bad taste from my mouth i was left with on my first purchase but thanks to all of you who offered great advice it is appreciated many thanks once again
the grinning idiot in the z4M !
