What's the proper step of securing it to be yours? What's to stop the government from putting their foot down (saying that its their property) to cut you out completely? :|

Nope, the scenario is completely hypothetical.

ok, that was in reference to an old tv show. However, I believe you just need to check to see if the land is currently owned and if not then stake a claim.

Only way you can claim it's yours is if you own the land. Otherwise...it would belong to the land owner, government included.

In our deeds there is a clause that states that any minerals found on the land dont belong to me but to the Earl of Powis who has mineral rights over large parts of Mid WALES and the Marches.

Many American deeds also explicitly exclude underground mineral rights. Who ever does own the rights can drill horizontally under your property and extract said minerals with out your approval or or even notification. I imagine all mineral reserves are already owned by someone, and it's extremely unlikely to be you.

It is possible to obtain mining claims from landowners for surface minerals, such as placer gold. Surface rights could extend down many dozens of feet. I imagine all near surface oil reserves are already known, it's just too easy to find compared to what's done to discover deep reserves.
