Speeding ticket issue

Didnt think i would be posting on here again so soon but wanted to ask your advice...

I came home to a speeding ticket notice today. As you might know i sold my car the other day and as it turns out it was issued on the day i sold it at a time after the ££ exchange. To my great relief! Obviously the letter still came to me as i would still be the registered keeper but i have section 9 of the V5 doc "notice of sale to the motor trade" as proof.
I phoned the guy (might not have been the best thing in hindsight) who bought it and he knew straight away and was even able to quote the speed he was caught at. The thing is he mentioned that he already has a summons for speeding so i am concerned that there may still be a way for it to come back to me? After all, his job relies on driving. Of course im not suggesting in anyway that he will be dishonest.
Apparently there is photographic evidence but i dont know if it shows who was driving. I was in the office at the time with witnesses able to place me there.
I intend to fill out the section "if you are not the registered keeper" and enclose a copy of the V5 slip

Hopefully i am worrying over nothing and but thought i would ask your opinions.
 
In my opinion you should be safe. If it ends up in court and you have a witness able to place you in the office then I don't see how they could pin it on you. I would guess they will look at your address, his address, the time the offence was made and the direction of travel (i.e. going towards his house from yours etc) and assume it is him. Did you have a witness to where the car was picked up? (i.e. you werent driving it to his house etc).

Push comes to shove I don't know how far it could go... I mean if he stopped for fuel then he would be on CCTV going to pay, but you won't have access to that. I guess the police would though, although whether they would go to that extent for a speeding ticket I very much doubt.

I think at worst (for them) they wont be able to pin it on either of you, but I am no solicitor so I don't really know.

Well the guy is actually a buyer for a BMW dealer so you would hope that the evidence is indisputable?

I paid the money into my account before handing over the keys but i dont have a time stamped receipt - wonder if the bank can provide something if required?
 
dont the notices ask you to declare who was driving? never had one myself (luck rather than judgement). if the driver works for bmw i cant see there is much to worry about, if he relies on driving for his job that is down to the court to decide if he does or doesnt get a ban. if you have witnesses at work that should be enough, if you paid in cash at the bank its usually processed straight away so they could pull up a time from that if you needed it but i doubt youll have to go that far!
 
The bank is only a phone call away! i would be very surprised if they didnt have a time in hours.mins record of when it was paid in.
If it wasnt you i wouldnt accept it, why should you.
 
I would not get into all the minor detail of it. Simply return the ticket with the copy V5 state the time it was sold in a covering letter and the name and address of the purchaser and that the named driver confirms he is aware of the offence.

Leave the burden on the other person to prove he had not collected the car if he is so stupid as to dispute it and only then bother with all the minor evidence.

You will find that much of your 'proof' is actually not proof. Paying money in does not prove you were not later driving the car, etc. Witnesses to place you elsewhere does not prove that say your partner was driving not the buyer, etc.

If it does go further then you'll likely find the camera has a picture and if to court then the other guy will look an idiot given all the circumstantial detail you have.

Not a lawyer but spend my life working with them....lol
 
You got nothing to worry about, I one got a speeding ticket come through the post on a courtesy car I had from the dealers, I was shocked, looked at the time it was committed and I realised I was at work, I then looked at the date of the offense and the location, turns out I didn't even have the car on that day, I had it the day after. Turns out it was one of their drivers delivering the car from another dealership, looks like they just wanted to palm of the ticket to some poor sod.
I basically told my local dealer where they could stick their ticket and filled out the form the best I could with a coving letter and I never heard any thing since
