Speeding penalty

My daughters friend has just been caught by a police car for speeding.
She was clocked at 53mph in a none residential 30 zone.

This is a Cat C speeding offence and the penalties are documented but what can she expect in normal course of events?

The girl is a mobile hairdresser so her livelyhood depends on her mobile status - she will write a grovelling letter of mitigation to be submitted with her guilty plea.
 
Does she currently have any points that may take her into automatic ban territory, or is does she currently have a clean licence?

If the latter, if she's offered a fixed penalty, then take it. No mitigation will be considered though.

If the former, and she wants to plead mitigating circumstances or exceptional hardship to avoid a ban (doing your job / running your business doesn't count), then she'll have to go to court...preferably with a decent solicitor.

She currently has a clean licence but intends (she tells me) that she will plead her guilt by letter. I don’t think she could express herself very well in a court scenario so I suggested she instructs a solicitor but she doesn’t seem keen to spend the cash. I’ve said that it could be money well spent!
 
I may be turning into a conspiracy theorist because I now believe the speed limits and penalties are being set with the sole purpose on cutting down traffic numbers, and revenue raising, not for safety reasons.
 
I take it she has been driving more than two years, otherwise her license will be revoked, the law says, and bear in mind this is if it goes to magistrates - in a 30mph zone, if you are caught doing 51-60mph, 6 points OR disqualify 7-56 days, licence endorsed,

I don't personally think a grovelling letter will make much difference if they just hand out the points and fine, if as I said above it goes to magistrates then she can put her case over in person

To a point I agree they are big money earners, there was a outcry recently in Oxfordshire, where they switched off quite a few cameras because "they weren't paying for themselves", surely that's not the point of a speed camera, but back on thread, most 30mph are in residential areas, and none of us want anyone speeding when there are children or older people about

53 in a 30 is not just a bit over the limit, not far off double the speed. It's bloody annoying when people speed past our house.
One day I could hear a car approaching at speed, so I walked onto the footpath holding a garden trowel up at head height. He must of thought it was a radar device because the c$nt hit the brakes hard. I then gave him plenty of hand gestures as he realised what it was and sped off. Made me laugh :rofl:

To be fair to the lass - she didn’t do it intentionally - she told me that she overtook a 15mph tractor and once passed it she accelerated away with her brain in neutral !
A silly lapse of concentration but one with potential safety implications and one with definite financial consequences.
One thing is certain - she has learned a lesson, even prior to the court outcome.

I had a similar scenario last year, 54 in a 30 mph zone (none residential area) and like her I had a clean license. Got 6 points and a £1200 fine. They do take your job/circumstances into consideration before going down the ban route.

The guy who had appeared before me got 6 points as well, no ban even though he already had 9 points.
 
Just chatting to my son, one of his friends got caught 52 in a 30mph, he got 6 points and he thinks a £400 fine, no ban tho
 
Yes we have all sped in the past and many still do. I'm really aware of my speed in built up areas and get great pleasure slowing speeders who fly up behind me in a 30 zone. I agree that some speed limits are just plain stupid, Oxfordshire council really hate vehicles (unless they are electric or pushbikes) and love to impose 20 zones all over the place. These near schools, I understand but not in an area where there is no need for such draconian speed limits.
Instead of hanging, how about a day in the stocks then Ron :whistle:
 
Good solicitor will cost £1500 to £2000, court fees will be about £1500, and then of course the fine itself. I can introduce you to a good barrister who specializes in traffic law if you want?
 
To date I’ve been very lucky - but as I grow older it’s speeding by mistake that will catch me out!
Ie drifting into a 30 from a 40 zone.

I think I did more speeding with 35hp than I do with 350 :rofl:

Today I took the main road through willesden heading towards the north circular, the speed started off at 30, dropped to 20, increased to 30, dropped again to 20, then ended up back at 30, that is in the space of just under a mile, How anyine is spose to not get caught speeding along that road is beyond me.

The general speed limit in residential is now 20mph, and thats only if you can get up to that speed with all the speed humps and potholes in the roads.

Indeed, on my commute there is a 3 lane dual carriageway with a 30 limit. I really can't understand why a non-residential dual carriageway with traffic light controlled crossings etc is a 30, yet a few miles away a similar road is 70...
