Speeding Fine - Verbal NIP rules

Got pulled over on 07/04/19 overtaking a caravan up by the Evo Triangle.

The PC was nice enough and said he has the gun set to only go off after 77mph in the 60mph overtaking zone he was sat in due to how busy it was up there on a sunny Sunday afternoon.

He clocked me at 84mph at 528 mtrs

Its now 18 days later and still haven't heard anything, does the 14 day rule still apply with a verbal NIP?

Furthermore it is also confirmed a verbal NIP also should be served in 14 days. Phew lucky you!
 
humm im not so sure, the way I read that is as long as an NIP is served within 14 days (which it was at the road side) then it stands.
 
If the officer gave you a verbal NIP at the roadside then a written one is not required.
The written one is sent when you have no contact with an officer eg speed camera offence.
 
So was an official NIP verbally served by the office at the scene? If so it woukld appear you are stuffed.
From memory I seem to recall they would then need to notify you of any further proceedings within 6 months, any later and they will have missed their opportunity. I do of course stand to be corrected on all accounts.
 
The point of the NIP is to warn you that you are at risk of prosecution (so can get your defence together if you have one). As Dav' says if you are stopped at the time and given a verbal NIP that's it, the RTA is complied with. You can hope they forget to instigate process within six months, but I'd prepare to just bend over and take it.
 
84mph to overtake a caravan ? :wink: Personally I wouldn't go anywhere near the Evo Triangle now, just asking for trouble. There's far better and less policed roads elsewhere in N.Wales if you know where to look :driving:
 
The current sentencing guidelines for 84 in a 60 limit is Band 'B', so attracts a sentence of disqualification for 7 - 28 days OR 4 -6 points and a fine starting point of between 75 - 125% of weekly income :cry:

Yup, concur with this unless the law has changed.

Many many years ago I had this & received it just before the 6 months deadline was up, because then the points stay on your licence for 6 months longer.

Does this mean you can ask for a months disqualification & no points, though Issue with disqualification is all the vehicles you can drive are reset

Anyway, convictions with their offence codes and points or disqualification stay on your licence for a min of 4 years either way and is disclosed for insurance and future tangles with the law, so why try and ask for a ban?

If the ban is for under 56 days you get your licence back automatically without application, I'm not sure what you mean about "resetting" vehicle types? .Gov is your friend :wink:

I got a ticket for something similar, but mine was relatively a long time ago.

Mine was for overtaking a 50mph 640D on the first straight bit we'd got to (on the A5 between one Evo section and another road). As the road straightened, I indicated, pulled out and floored it...so did the effin' 640D :x

He chickened out at about 75mph, but I got up to a bit more of that, and pulled straight back in and dropped to about 70mph again and carried on up the road.

About a mile further I turned off, and then saw a marked 5-series turning off from another side road behind me. This road was a tiny single-lane one, so once he flashed his blues, I waved back at him, slowed down and drove to somewhere that we could both park up without blocking the road.

He explained that he'd been parked on a road parallel to the A5, but about 50m up the hill, he knew this was the first safe overtaking opportunity (shooting fish in a barrel).

We had a chat, he liked the car and meaty exhaust, and also told me that they'd not bother below 75mph, but at 95mph I was pushing it :P

He'd seen the 640D, who was a local, and that's why he 'chickened out at 75mph), and said he'd noticed I'd dropped straight back down to below warp speed after the overtake, so would 'let me off' with the highest speed he could deal with at the roadside, which was about 83mph, so 3pts and £60 fine (told you it was a while ago) :thumbsup:

I'm probably due another ticket soon, as they seem to come in about every 5 years.
