And all too familiar tale – second hand car sales are certainly not the responsibility of BMW UK and any sales or subsequent disputes are between the local dealer and purchaser although BMW may bring some pressure to bear. If the pre sale inspection report identifies the tear prior to sale why did the purchaser not notice it on pre purchase inspection? This is where it pays to take your time and not let your heart rule your head. In many instances a company will take a case up to the line in County Court in the hope that you will give way and then at the last minute make an offer. They certainly can’t afford bad publicity from an adverse outcome.

Lets hope it gets sorted....
 
Of course there is only one side to the story here so I always have a cautious view of the posters 'truth'

Really need to check cars properly, take photos on inspection and if it were damaged walk away on the morning of the sale, not simply carry on and buy it. In my opinion they accepted the fault by doing that unless they got writtten proof it woudl be repaired/replaced.

Interestingly they were offered a second hand hard top free. As the last poster athe time of me writing this notes. I'd have grabbed that, purchased a soft top and had it fitted and still be in pocket. Of course ster clear of the County Court. Slow, slow, slow and you have to fight a powerful entity and the evidence is all verbal.

Such evidence is not worth the paper it's written on :)

I see it most likely as the salesman said they would get it repaired, customer paid up- sale done (not confirmed in writing - big mistake). Specialist later says it's not repairable, salesman speaks to his boss who says 'no margin in that sale - tell them to take a hike'.

Salesman thinks up a series of half arsed offers to get the customer out of his hair. No side prepared to compromise, now customer goes to court with potential of losing case :thumbsdown:
