Roofing Supplier about to put a lien on my home

I get this letter in the mail from a roofing supply company stating that the contractor has not paid them for supplies used on my home. The work was performed in June 09 and I paid in full the agreed upon amount as stated in the contract between myself and the roofing contractor. Well apparently the contractor has not paid the supplier and now they're going to put a lien on my home. How is that fair? I feel like they're putting pressure on me to pay the legal fees and do the leg work they're supposed to be doing on their own.
All I can do is take the guy to small claims court which still doesn't insure that'll he'll pay the supplier. The only other thing I could do is pay the supplier for the materials to prevent the lien on my home, in which case I would be paying TWICE.

Has anyone dealt with this? What did you do?
 
All I can say is get a good lawyer.

We had a contractor try to take us to small claims because we stopped paying him--the work was atrocious and we told him so. We documented all the things he did wrong by taking pictures (I'm not talking minor stuff, I'm talking 3/4 inch gaps in the trim filled with caulk, door installed without removing the old, deteriorated wood, etc). He went first, judge asked if we had documentation, we showed him the pictures and it was all over. We didn't get any money back, but we didn't have to pay the idiot any more money.

If you have all your receipts, canceled checks, etc. You should be fine. Another way to get them is if your local television station has a consumer advocate. Amazing how fast money is forthcoming if they're going to be put on TV having to explain why they ripped you and the supply company off.

WOW... I know a contractor can place a lien against a property that they have made repairs/improvements to if they don't get paid but the supplier to the contractor... :o
You need to talk to an attorney... :!:

Yup, I spoke to a few lawyers and there doesn't seem to be many options for me. I either pay the money or the money to the lawyers. Either way, I'm going to be out a couple thousand dollars on top of the money I already paid for the roof. I contacted one of those consumer advocate places and they basically told me I should have known better and that it's pretty common? I knew to check for license, insurance and customer reviews. I didn't know about the affadavit I was supposed to get signed by the contractor releasing me from any liability by their suppliers.

Oh and I've found out that this exists for all states. So watch out.
 
wow I am a building contractor in the uk if you lived here the contract is with you and the building contractor,the supplier can have no claim on you what so ever , he would have to chase the contractor for the money and if he cant pay they would have to take the contractor to the small claims court , good luck mate :cry:
