If the new flue is in the same location as the old one (i.e. exits the wall in the same place) then you haven't made any external modifications. All you've done is add an extender to it which is due to regulations.

Sounds about right to me. Def get some proper legal advice on this, I think it is a bloke with a big gob (probably why he is head)
 
Do you have any photos of the previous flu installation ?
Maybe sales photos when you bought the flat ?
 
Yep, I have photos for the installs. New flue is in exactly the same place, is actually smaller and is there to meet regulations. He is saying that I now need to move the boiler to somewhere else in the flat.

So today he was outside pointing with a group of people at the flat, so much so the OH was scared to go outside. She also heard him referencing my ethnicity, and calling me a liar because I have a Z4 w,hich has nothing to do with boiler flues!

I have £50k work of legal bill cover on the Home Ins, the OH has Legal Support through her company and I have engaged the services of our conveyance Solicitors and my mate who is a Criminal and Civil Lawyer and runs his own practice.

As I work away a bit, being concerned for the OH who feels trapped + the racial connotations have decided to go to the fuzz.
 
My big worry is if the fuzz pay him a visit, then he will use his position to fine us and make our lives even more difficult. But it really is causing us loads of distress. Twice is two days has he been standing outside and gathering people to point in the window.
 
Wildfire, check your home/property insurance for a section dealing with legal help. A lot of these policies will give you free legal advice and then supply a solicitor if you get sued.

Yeah. I want to speak to them about it the retaliation thing. But we'll be reporting the standing outside. Regardless of what is said outside it is not very nice to see a group standing outside looking in your windows.
 
After reading thro this post again, I detect that there is more to it than a boiler flu pipe and one mans rant!
 
From what you have said here and your similar post elsewhere , if he's being racist I would be tempted to call him out and tell him to do one and mind his own business , but I wouldn't say it as politely as that , then call the cops and make his life a nightmare
 
Can't you call a meeting of the residents association and put your case in front of the other residents?

It sounds like he hasn't got a leg to stand on, show your photographic evidence and get your legal mate in if possible.
 
Make sure you get this "mob" on camera! I would install a permanent cctv camera.

Commenting about you ethnicity - what's wrong with these people! Makes my blood boil! (I think your right to involve the police)
 
OP I understand your pain, we all now have to endure the unsightly (longer) flues since the introduction of the (supposedly) greater efficient condensing boilers. What you haven't yet mentioned is the resultant ''pluming' condensing boilers give on a cold day, the boiler pluming will do a very nice impression of the Queen Mary at full steam ahead, and theres not much you can do about it!

Residents associations cannot evict property owners. They usually exist to manage communal maintenance issues on multi-occupancy buildings. Even if the leaseholder held you in breach of a specific clause due to an un-authorised alteration to the building, a small flue extension would not be just cause for such dis-proportionate action. If it is compliant with planning law and building regulations then there can be no 'public interest' issue to answer.

It seems there must be more to this story or at least some history between you and this apparent cheesedick. Why not post a pic of your flue for context?
 
just out of curiosity, what was the racial slur? there is no place for that sort of thing. (you dont have to say if you dont want to)

it might be a good idea to start keeping a diary of things like the gathering/mob/slurs etc and when there is sufficient evidence get some sort of restraining order.

have you spoke to any of your neighbours about this? find out what they think...

hopefully it will sort out and the nobba will do one... might be worth buying the mrs a bunch of flowers to cheer her up a bit?
