We saw approx. 130'ish.....Poor little Mitsu Spyder GT and the WRx Sti did not know what was sitting on the sides watching their antics till it was too late :lol: :lol: Honestly thought the Subi would have at least kept up, if not passing me, guess he was too worried about his (under 25) liscense, LOL.

The dealer is wrong to demand anything in this situation and he/she knows it.

If what he says is true, then he screwed up in this situation and has no legal or moral comeback on you.

Keep your car and money.
 
finaly got to the bottom of this whole mess......
the peugeot has had a new bsi/ecu board along with a new instrument cluster due to an electrics failure which was done by evans halshaw [ peugeot dealer ]
evans halshaw is now going to pay me compensation because they failed to notice or tell me this so i will use the compensation to pay the dealer i bought the z4 from.....the aston martin dealer was so good to me when i bought the car i think its only fair that i give him some of the compensation..only some of it mind.
thank god its now been sorted.
many thanks for all your comments even the ones that indicated i could have possibly been messing with the mileage.

well at least you got to the bottom of it, id still tell the dealer you bought the z from to take a jump and not give them a penny :evil: but at least its not going to cost you anything :thumbsup:
 
I strongly believe in that "what goes around comes around..." if i was in your situation, i would pay the Aston Martin dealer what ever compo you get from the Peugeot dealer as you would be making money off someone elses' loss otherwise and at the end of the day everyone will be happy if you hand over what ever compo you get from the Peugeot... only my advice though, best of luck with your decision, interesting story
 
oo7ml, I agree, profiting from a situation where someone else loses out is bad karma, and I try to avoid wherever possible.
 
IMHO That kinda depends the amount he's been offered from peugeot!
If The dealer (Aston) needs £1500 to be straight on the car he's accepted as trade then thats what I'd pay him.
If Peugeot are offering say £2000 I'd defo keep the extra £500 for all my inconvenience.
That way everyone is straight and no one loses out.

I agree its not good to profit from someone elses loss, but as long as the Aston dealer is happy and gets enough to be straight then no one IS losing, other than the Pug delaer who cocked up.
 
Looking at the laws of contract he can sue you for damages which would be the shortfall in value for the car. The main problem is that the verdict might go either way depending on proof of it being clocked whilst in your ownership. It should be able to be traced back on past MOT's etc as if the dealer found it has been clocked then there some be some indication of whether you owned the car when it was done. Ask them for proof mate and if you never done it, then there shouldn't really be a case againt you.

This is not legal advice btw :P
