Hi thoughts on this one ! Last week parked our car in local Aldi/Iceland carpark to take my gran (86 years old) shopping,takes a while.Then on the door step today a letter from a company called Parking Eye with a Parking Charge for £70 for staying in the car park for 1 hour 51mins & a nice wee pic of our car driving into to the car park & a other of the rear leaving the car park 1 hour & 51 mins later.States if we pay before 26th July the charge will ONLY be £40 or if we don`t pay before said date the charge will be £70 ! Sounds sus to me, anyone had any experiance of this kind of thing.

It's nothing more than a speculative invoice, so ignore it.

Also ignore the follow up mails/calls - even if they do look/sound official, as these buggers will put official looking crests/logos on their letters claiming they're about to take you to court.

Maybe send a letter or speak to the manager/area manager/head office of that specific Aldi/Iceland that you don't feel valued as a customer when you come back from shopping with your 86 year old gran, to find you're being harassed for parking. Include a copy of your receipt if you wish to prove you were actually shopping and not dogging.

Was there a time limit on being there and was it clearly signposted up? Do you still have the shopping receipt proving you were actually there using the store?
If you strongly feel you are right then write a letter.

I was in a parking charge situation a couple of years back and I felt strongly about not paying. After a couple of letters and no cancellation of charge they threatened to go to court. I went, represented myself and won. Depends how you feel about it. It did drag out the stress for a while though.
 
Similar thing happened to me but I was parked in a disabled parking place and my mom's disabled parking permit had slipped onto the floor.
I had a ticket on the car saying I'd been fined £70 for non display of a valid permit.
I did a bit of googling and found out they couldn't enforce such a fine.

I wrote to them saying I wasn't going to pay and had a threatening letter back saying the fine would rise.

I just ignored the next two letters they sent the didn't hear anything again.

Have a google, there'll be other people who've had dealings with Parking Eye and you'll get an idea where you stand.
 
I would ignore for the time being, unless they threaten court action

Hi. Same thing happened to me at Morrisons. Their max stay is 2 1/2 hrs and I was there nearly an hour over. Their parking signs were ambiguous as all the pay and display meters were covered up. I appealed telling them this and because I suffer with bad back it takes me ages to get round. I still had the till receipt for £192 so I sent that in with the appeal letter. They waived the charge. I told them I thought it was outrageous and how can they justify an £80 "fine" when for less than an hour over when the pay and display is only £3 for 2 1/2 hrs.

It seems that the till receipt I sent in made all the difference. If you still have that I would send it in. Otherwise a copy the transaction of your bank statement if it's on there.

As they are not the council nor the police they cannot force you to pay without taking you to court. You are best to appeal and not pay.

If it's a private charge/invoice, then do not even reply to appeal, as you are then admitting to being liable for it if the appeal fails and gives them ammunition for a court order.

If you don't reply at all then they've got no evidence of you being the driver, or of you agreeing to the contract terms and thus have no ground to take you to court.

Read the links posted and make your own mind up. I know they rely on people being worried about having to go to court, or having debt collectors turning up, but that is how their scare tactics work.
 
I have experience of Parking Eye as they used to run a loading area where I had a shop. Here are some key things to know about any non local authority parking ticket.

1. They are not parking tickets, they are invoices, and as such they come under Company law.
2. they have sent the invoice to the owner of the Vehicle, under no circumstances tell them who was driving, as under contract law they can only invoice the person who parked the car, and who drove the car out, not the car owner.
3. Just keep the invoices and any other letters but never reply.
4. The only time to respond is if you get any court papers (which is very very unlikely).

I know it's easier said than done, but just ignore them. Never enter into correspondence.
 
I had a private parking ticket, after doing a lot of research on the internet i ignored all the threatening letters untill after about 4 months they stopped.They have to prove you entered a contract with them by reading there sign in the car park and then pay a fee to take you to court. If your found guilty the judge is likely to only award reasonable cost of 2 hours parking.These people are bullies ignore them :!: and think they paid £10 :lol: to the money grabbing gits at the DVLA
 
Do nothing, just ignore it, they may threaten county court action but the first ownus is that they have to prove you were the driver.

In any of these private car parks you enter into a contract when you use the car park, if you stay longer or just not pay then they can pursue you for breach of contract. They rely on scare tactics to make you pay, if in the unlikely event they decide to start proceedings you can make an offer of settlement, basically any amount that you feel like say £5.00, they would then have to prove to a judge why this was not an acceptable amount.
 
I paid one of these once for overstaying in South Mimms services - never again, now I know better. I left it a long time before paying, was going to ignore it, then just succumbed. Feel like a prat now, but better armed for next time :thumbsup:
 
If I sent you an invoice, would you pay it, of course not, well it's exactly the same, don't worry about it, they will send other letters that look really official, they're not, they are just made up invoices that's all.

Just make sure you don't reply, if you reply they then know the letters are going to the right place and will be more inclined to pursue you.

they buy the car owners address details from the DVLA, but thousands of people move every year and forget to update their address details, so if you reply you are just helping them.
 
Cheers Folks. The wife wants to pay it ! But showed her the posts on here & now she`s put the Parking Charge in the drawer ! Result ! Don`t mind paying if i was in the wrong.But will need to get skates for the auld yin ! Just back from checking the car park out & thers about 6 signs stating max stay is 1hour 30 mins. oops :oops:

Looks like they don't want people to spend time in their shop...
