You end up with a defunct gearbox that should not go wrong, late or no V5 and dealer happy to refund in full without a fight.
Strange very strange. At least it won't be sold on to a forum member.

Bit of a first with a terminally doofed manual box in a low mileage Beemer! Hopefully that's your share of bad luck out of the way and things turn around for you, your mum and family come the new year :thumbsup:

Hope it all goes well today Rob, getting your money back and that things improve regarding your mum.

I have to say I share the suspicions of others regarding why the V5 wasn't sent. With the recent change in the law that came in a few years ago regarding the sale of goods and particularly your ability to reject/return it within 30 days I'm inclined to think the trader knew that there is, or at the very least, that there might be an issue with this car. He probably wanted to get through the first few months before sending it off and if you quizzed it, he would just blame the post/DVLA.
That way if he had to take it back he wouldn't have to explain away an additional keeper for all of a month to any potential purchaser down the line. These days you dont even need to send the V5 off, you can do it all online whether you trade or private. My wife recently changed her car on a Thursday and had a new V5 by the following Tuesday, I was surprised how quick it turned up.

Hopefully you'll get the money back no trouble. If you flip the situation on its head, the last thing the trader potentially wants is you going off and spending £4k on a gearbox billing him and potentially taking him to court. Those high court sheriff programmes on the TV these days seem to feature at least one motor dealer per show and usually doesn't end at all well for them! Its like you said Rob you shut down his potential to fit a used box so his next cheapest route is to take the car back and dispose of it at auction loosing a little or maybe even breaking even. Failing that he could fit a secondhand box and depending on his margin might still make a small profit when he eventually sells it again.

But as the saying goes "everything happens for a reason" and the bright side is that in few weeks time you might be driving a 35i/35is.

I am considering the 28i as well for fuel economy reasons but I will have to test drive one first.

Off topic - how would you ever make the sums work? For the '000s you lose on your car selling it and buying a 2.8 you could have done about 50k worth of petrol (sums just as an example ...).

I read from the quoted bit that you would sell your 35i to buy a 28 instead because of fuel economy reasons?
 
Yes, Correct !! I bought my 35i recently and it is mint so I don't think I would loose much ££ on it. Rob mentioned that he would be considering a 2L so just responding to him and not really "Off Topic" I guess.
