List of problems.. Back from dealership with more problems..

That's what I am hoping for Kevin... Well to be honest I cant afford to be paying any more than I am now othewise I will be out of pocket.

I thought about another zed but my confidence has been knocked with them. The whole repeated leak issue not only on mine but others aswell makes me think I would be setting myself up for another fall.

Guess I will have to see what he comes back with.

There shouldnt be a problem though as my current zed on the configurator comes in at around £36.5k including service pack. The 328 I have specced up comes in at £36,150 without the service pack and the M135 comes in at £34,700 without the service pack.
 
I think the F30 M sport is a gorgeous car :thumbsup: I like the M135i too, am surprised it's so 'cheap' over there :o Costs about a 10k Euro more here :x

So I thought that the conversation last week with the DP was the start of things going in the right direction.

I specced up two cars, both in the region (one quite a bit cheaper) of the list price of my current zed and sent them across to him for him to look at.

He rang me back yesterday and for me to get into the 328 M Sport they want another six grand of my hard earned and for me to get into the M135i they are wanting another five grand. WTF???

When I said OK so if I was to go for exactly the same car as I have now (which is more list price) you wouldnt need any money up front.... Erm no, I would need about another 5 grand for that aswell...

Erm.... How about I F*ck your mother????

BMW FS havn't really been any help either. I sent across all the information to them on the 11th September and was told they would investigate it straight away. The dealership hasnt heard anything from them and after I rang them yesterday they said they had received all the info but nothing has been done about it.... the girl dealing with it was away from her desk and I am still waiting for her to call me back despite me leaving two messages with her and sending an email...

Really really really at the point where I could set fire to someones head over this..

I am thinking about contacting trading standards but dont know where that will get me :(
 
No, no, no. He can't do that. He is replacing your car as it isn't fit for purpose so therefore he has to replace it like for like without asking you for more money.

(Edited to say, my new car has no leak issues after a few heavy rain showers)
 
Just edited the above carol to mention about BMW FS....

He did say to me yesterday that he isnt replacing it as the car isnt worthy of rejection. He is trying to look after me as a customer by selling me a car at zer profit...

You can imagine the number of choice words which came out of my mouth when he threw that one at me!
 
Ring everyone. I did. Trading Standards, citizens advice et al.
You have got to make a pest of yourself, especially with the finance people. They have got major clout with the dealer. Tell them all you are going to see a solicitor and get legal advice and if that doesn't get a boot up their ar$e then go and see one.
Tell them you are reporting them to Trading Standards and that you are going to file a complaint against them at the CAB as well.
Ring BMW finance again if she doesn't ring back within a couple of hours, then keep ringing them.
I know it's frustrating having to do this especially when you are trying to work as well. :x
 
Carols right you gotta be pushing the rejection route as it looks to me the dealer is ignoring that side of it and looking at your car as a trade in. This is what the garage will be pushing for as they want to make more money out of you, I'm not sure how it stands if you bought the Zed with the BMW contribution and cheaper APR that they were doing at the time as I'm sure they won't want to be out pof pocket if you went for another car of similar value.

Just gotta keep pushing them and hinting at legal action. All very depressing as there are others going through a similar ordeal. People really don't need this sort of worry over a flipping car.

Agree with TitanTim - step outside the proposed 'rejection' route and you may well loose the opportunity to go back to it if it all goes wrong. In agreeing an alternative solution the dealer will I am sure get you to sign something agreeing to this which may expose you if you subsequently decide on the rejection route. I would certainly advise seeking appropriate legal advice and politely notify to the dealer IN WRITING that you will be doing this and where appropriate seeking to recover the costs from the dealer. Worth copying BMW UK into this letter as well. Hope it works out to your satisfaction AND NOT THE DEALERS!

J it's not, I don't believe in your best interest to be looking at messing around with your original agreement which is what will happen if you have a different car. This is the only power you've got.
 
Not wishing to put a dampner on things but I'm sure there is a cut-off date for rejection, bear in mind that Jon will have taken delivery ummmmm must nearly 6 months ago and it could be seen as thats too long a time to get a new vehicle. I just remember looking into all this with trading standards when I rejected a Peugeot and it was something like 4 months, might be wrong but the dealer or BMW might say well we won't get you a new car but how about a like for like replacement in current value and age? sounds ridiculous I know but this is a problem that happens where your trying to get numerous issues fixed over a long period of time. I often think its better to have a cut off time of 2 months after delivery and 3 atempts at fixes and at that 2 months you go the rejection route.

I think with the Peugeot it was 4 months by the time I got the rejection approved.

Tim, there has been problems with the car from the first week of collection. My first letter stating that I wanted to reject the car was dated 9th July 2012, just three months after I took delivery of the car.

Upon the request of the dealership I gave them the chance to rectify one last time.

Alan, I have copied BMW UK into just about every letter and email and all they do is bat it back to the dealership saying that they will sort it.
 
I got into a brand new Audi from a very nearly new purchase at over 12 months, you have to get to the very top!!

I would speak to a solicitor now to be honest. If they are going to fold then a solicitors letter won't cost you much. If they are going to fight it you will need to lawyer up anyway so may as well get in early. Sounds like you have done half their work for them with all the letters, photos etc, so I don't imagine it will be a particularly difficult task for them.
 
The seat rattle may not be worthy of rejection, but the leaks are!

It's not the dealers choice...he isn't looking after you!

My BMW finance lady was a pain to get hold of (never returned calls) so I asked to talk to someone else and then miraculously the original one appeared!

If he can avoid rejection, then yes, it's a trade in, which isn't right. Fight for rejection and replacement with identical car, then the finance docs don't change (they just alter the vin and reg no) but no other details change.

Remember...you bought a new car...you haven't received a suitable example yet.

And I don't think a cut off applies cos you told them of the faults ages ago, the delays (as in my case) have been their fault!

Don't give up, it is stressful, but treat it as a fight for justice and calmly list your cars faults, their attempts to rectify and say they clearly can't fix it so you want a replacement. Get back onto BMW finance and demand to speak to someone.
