Large pothole = 2x buckled wheels

I've got a buckled wheel from a large pothole too. Passed it's MOT with just an advisory on the wheel and this was at a BMW dealer.

The wheel is out of balance so above 85 it starts to judder a bit, keep meaning to get it fixed but it's really hard to find somewhere that will repair the wheel when I'm not using the car!

Didn't bother chasing the council as it looks like a PITA.
 
Our Fiesta had 2 buckled wheels when we got it, it was even noted on the previous 2 MOT's as advisories.
 
What's annoying is a lot of these potholes have been repaired badly from last years weather.
My regular route all the potholes have appeared again in the usual places.
 
Soon we will all be paying Road Tax instead of Vehicle Excise Duty.......doubt we will see any change in the state of the roads or the funding the councils and other organisations receive to keep the roads intact.

There always seems to be roadworks when the weathers crap. It's never during the summer or dry spells. I also notice lots of holes appearing on the A1. Potholes are dangerous at the best of times but on major roads at 70mph it could be disastrous!

:lol: better get chopping the 35 in for a 18 if I want to see mpg like that!
 
I have experience of Durham Councils attitude - after damaging a wheel and tyre my son in law made a claim - the they said that the road had been inspected in accordance with their statutory duties - they wanted a chunk of cash to see the report .

He gave up ! ( I think I would have tried the freedom of information route)

A few Months later the road was re surfaced.

Bandits !

How much was this 'chunk of cash' as I think they are only legally allowed to charge £10 to access the information a bit like if you contact anyone you've ever dealt with you can ask for all the information they hold and they'll says yes sir, that'll be £10 please.

I would of kept at them personally. My cousin took out her tyre recently on a massive hole. I feel bad for her but on the other hand she did know it was there and wasn't paying attention. I've seen me find an alternative route or just point blank refuse to go somewhere if I know the road surface is shocking.
 
I wouldn't have given up either - it would have become my crusade!
The fellas father dealt with it so I'm unsure of the cash the county councils bandits wanted !

Too many people are put off by the way they are dealt with and the hassle it seems to bring. If more people persisted then possibly they would actually take better care of the roads. At the end of the day it's not just cars that use them and major defects and the issues they can bring can effect everyone
 
I think what put them well off the scent, was that the council said that they had met their requirement to inspect the road within the timescales !

I was going to say the same yes. If they already knew about it, then you should have good grounds to claim. The fact they filled it so quickly does seem to indicate that they were already aware to me. Good luck anyway :thumbsup:
 
I always suggest one files a report of a pot hole or other defect via "www.filllthathole.org". The moment you click send, the council will have been advised and this makes their defence less defensible. Have to say its worked once for me and once for my son. Importantly you can also pop on the web site and see if anyone else has reported the defect and if they have the council are obliged to do something about it. Depending on the severity of the defect this could be instantly or within days/weeks. The more people that use fillthathole the better for all concerned.
Give it a go and watch in amazement as some holes do actually get filled in!
 
I've got proof that they already knew about it, including the reference numbers of the reports prior to mine. I took a screenshot of their web page showing this as well, as advised by somebody earlier in this chain.

The council office will be open tomorrow so we shall see whether the number they have provided in their claim confirmation email leads me to anyone who can help! I'm also taking the car to BMW to get them to quote for all the work that needs doing.
 
I heard back from the council on Friday and surprise surprise they are trying to wriggle out of it. Basically on the grounds that the road was inspected on 7 Dec and it was ok. I hit the pothole on 23 Dec. The road all around it is badly cracked and isn't flat. The pothole reappeared on 28 January and I have evidence of that along with details of people who hit it. I also re-reported it twice, once to say it was coming back and another time to say it was back. Part of my argument will be that their checks have been demonstrated to be insufficient for this road. Will do all the usual things and ask them to provide evidence of every report known including instruction certs, equipment calibration reports etc. It ended up costing me about £700 and I am half tempted to just take the hit but I am forcing myself to make the effort to write back. Time to make myself a nuisance to them!
 
My take on it now is you're done for.

Council will invoke a s58 defence that they inspect within national guidelines and did so on Dec 7 (every 3 months is appropriate)
You can't prove it did the damage (but of course you know it did), like say you crashed at the site as a result of blowouts. Photos can be date changed, etc.
You can't prove they knew about the pothole before your accident. Unless you found it on a pothole site or the council screenshot has dates of reports on it.
Cracked roads and subsequent potholes are irrelevant.

Sure ask for their December 7 report but you can be sure they have it to hand and will just leave you out to dry.
 
If you get no joy I would take them to the Small Claims Court - it will cost around £70 to do this or £60 if you do it on line but from all the evidence you've got you must have a good case - if they don't respond or turn up for the hearing judgement is automatically made in your favour .
