Hartge front spoilers on clearance

Hi all i was looking to buy an e85 3.0 for a project but then changed my mind. During that time I found out Hartge is about to go into administration and some parts are on clearance. I absolutely love the front bumper and I hope someone finds this info useful:

I Understand that you are looking for a quotation for the Hartge low front spoiler for your BMW Z4 03 e85 3.0i.

The front spoiler would be £246.75 + VAT and delivery. We have been advised by Hartge that there is no warranty available on this item due to it being clearance stock.

It's a bit of a red herring to say the manufacturer doesn't offer any warranty as it's a clearance item. Your consumer rights are with the retailer, not the manufacturer, but the retailer is basically telling you that if you buy it then then don't want you moaning to them if there's an issue with fit/damage.

If a damaged/wrong spoiler was received then I still think you'd be entitled to a full refund - and then it's up to the retailer to try to get their money back from the liquidated manufacturer.

UK distance selling regulations apply if it is delivered to you and Trading Standards will apply too - both reflect a contract with the vendor not the manufacturer. Besides, if you buy with a credit card, usually it's their problem to recover the money, not yours.
 
Yes, Distance Selling and Sale of Goods Act apply and are the responsibility of the retailer. Regardless of what they say, you can't waive these so don't worry about that.
 
IMO its gorgeous esp in black. i think it follows the lines of the body with a lower nose. I think it looks quite chunky too and of course its a Hartge item so hopefully fit should be spot on..

Hadnt thought much about the legalities of it all ... but from £600 i think its a steal. i would def have got one if I had bought an e85 ...
