Friendly and/or Legal advice needed?

UPDATE.

PayPal have concluded their investigation in my favour, HOWEVER, I have received only £67 of the £250 paid.

Apparantly, this is because PayPal do not cover deposits, only tangible goods. The evidence I gave, was therefore not even able to be considered from PayPal's viewpoint.

The reason why they have found in my favour and been able to recover £67, is that the seller offered to refund the £250 less the supposed costs he incurred (using MY money) of £183 for Tax and MOT.

Might give Citizens Advice a look next

I think what you need to do is take this to a legal eagle as I dont think its right. Did he use your deposit to tax and MOT the car? If thats the case is that legal in itself. If he has taxed the car I think he may have done it under his 'trader' :wink: status and if thats the case you cant have the tax disc cause its basically not yours till you actually register the car to you which is basically pants :thumbsdown: :thumbsdown: :thumbsdown:

Must admit I looked at my car, came back 5 days later, I travelled to Preston 140 mile yourney so that was enough for the dealer to appreciate how interested I was and he never asked for a deposit nor did he even hint at one before or after the viewing.

The guys a scumbag thank your lucky stars you didn't buy god knows what issues you would/might have had

Just to bring some closure to this thread, I went to Citizens Advice and the advice was... no chance.

Lesson learned and I'm drawing a line under this now. I hope it helps someone from making the same mistakes that I made.

Lesson 1: trust NO-ONE (even if they sound absolutely genuine).

Lesson 2: never leave a deposit before you've seen (and tested) the goods.

I'll introduce myself properly in the Newbie section shortly (need to take pics of my car first).

That really sucks, especially as it's a trader. I've bought plenty of cars off FleaBay and one trick I always ask for is a short walk around video of the car before I go anywhere.
The reason being, that it's very easy for someone to photoshop a static image to get rid of dinks, scratches etc. but video is a different story.
I'm surprised that PayPal took that stance and didn't refund you the total amount.
 
Quick check of the post code of the dealer on Google Earth will show you what sort of premises they have and may be a first indication of their quality as a dealer. This one shows a barn in a field with loads of white transit type vans....... :thumbsdown:
 
I have to disagree somewhat.

You paid a deposit against a car described as immaculate. It wasn't.

I am assuming that he taxed it on his own initiative and NOT at your instruction, ditto the MoT? If that was the case then Small Claims Court would get your money back without question and a CCJ for him if he doesn't cough up, since anything he did at his expense to make the car road legal is just that, his expense.

But then for £250 can you be bothered? Personally I would, just to piss him off.

Me too. I would also make sure the local rag were informed, just to ensure that no one nearby would anything from him, at least for a while...
 
OMG I was looking at getting that car also, but thought the asking price was a little high, dodged a bullet there me thinks as I've got an awesome car now. Sorry to hear about the problems you've experienced there mate, he'll get his just desert one day, karma... :P
