I want to make and upload a video to youtube......its basically over a dispute I have with a car dealer , it would be factual.....but I need to know if I,m leaving myself open to any litigation?

And no , its not concerning the Z

Not a legal eagle, but I would say yes. You could be placing yourself in a difficult position and if it went to court I would imagine it could be positioned to work against you. Surely it's your opinion that it's factual, I presume this has yet to be proven?

Just my thoughts, I'm sure someone will be along to give you an official position.

Unless you clearly stated you were asking for people's advice whether your gripes were justified or whether you were being unreasonable.

In this way, you are not making a direct acusation... maybe for completeness add 'Without Prejudice' as any written document with this cannot be used in a court of law against you or by you yourself.

Can you not simply make the video with all pertinent points without referring to the dealer?

There was an article in Auto Express a few weeks back about a guy who did just what you want to do.

I seem to recall he got what he wanted when it hit youtube.

I phoned Auto Express.....to see how/if the guy got around any litigation......The outcome is , they may take up my case and run with it :)

Thank you guys for your suggestions

Hey that could be a great result if someone big takes up your cause

Yes it can! The words "without prejudice" when added to letters, only mean that in the event of the negotiations carried on by those letters not resulting in any agreement, nothing in them is to be taken as an admission in any future legal action. It is used between parties in legal dispute.

You can't excuse libel by adding "without prejudice" to something you write and distribute publicly. That's like saying, I had my fingers crossed so it doesn't count.
