Yeah, that's right. I believe there is also a cooling off period where the buyer is entitled to a full refund as well.

I will be checking this cover gasket and the solenoid sensor first thing when I collect the car tomorrow!
 
So... Turns out it is the ECU being faulty!

It is being sent off for re-conditioning.

The process will take two weeks but does come with a two year guarantee on the part.

Obviously this is a major critical component of the car, the dealer offered me a refund for the vehicle as an option.

I don't suppose the ECU issue could cause any mechanical damage?

Apparently it wasnt giving a spark to all of the cylinders leading to a build up in fuel and thus flooding the engine.

What would you do in this situation, take the repair or take the money back?

Personally I'd hand the car back, you'll always be wondering what's going to go wrong next, also unburned fuel isn't good for the bore lubrication & neat fuel in the catalytic converter isn't good either.
