A friend of mine has just bought a used approved Mercedes from a Mercedes dealership. He’s had all sorts of issues with the sale process and he’s presently taking them up with the dealership in question. One of the problems he’s encountered is that there are discrepancies in the service history mileage, i.e. the latter 2 of the 4 Mercedes services its had show mileages in excess of the digital odometer reading in the car. The issue isn’t so much that he suspects foul play (in fact he thinks the car is absolutely genuine but there were manual errors in entering the data onto the digital service database records) but that it was down to him to detect and point out the discrepancies himself at the time of collection whereas Mercedes (as well as other dealerships) sell themselves on the excellent level of assurance they offer used car buyers. In fact (and this is the question he would like some guidance on) they even presented him with a certificate of authentication on the vehicle with a signed declaration which states that “the service history, where available, has also been checked for discrepancies”. His point is that this declaration is clearly untrue and he has plenty of evidence to back this up. In fact they are still trying to discover the correct mileages at services 3 and 4 after more than 2 weeks after collecting the car. So he believes this is a sort of false declaration and that surely there must be some legal recourse. Now he’s not necessarily suggesting he’ll go legal on them but he wants to know the seriousness of the potential offence so that he’s well informed when it comes down negotiating what Mercedes can do to compensate him for his troubles. Does anyone know what type of offence this constitutes, i.e. falsely signing a declaration of this sort?
