I recently developed a rattle and loss of power. I had the problem diagnosed by an independent shop as a failed cat and was advised to take to a dealer for replacement under the emissions warranty. When I did this, the dealer told me a rattle would not be covered and the cat would cost $1250 plus labor. I smiled and left rather than express my true feelings. A call to BMW NA accomplished little more than a promise that they would forward a complaint to the dealer. The rational seems to be that since there are no lights lit, there is no problem. I think it's just a stalling tactic to wait until the warranty expires and a lit does come on leaving me with the repair bill.
Interesting enough, MB NA had a similar problem in 2002 and replaced all of the cats in a large group of cars just because of a rattle in a few. Maybe I should have bought a Mercedes.
