eBay uk help need re motor purchase

The short story:

Auction for a car where the seller seemed reasonable etc....
Won the car and as per seller request paid it by paypal( 1k)
Seller now refusing to allow me to pickup car/ send tow truck to pickup car/ transfer car
Seller does not want to refund me my money
Seller opened a cancellation of order form( which screws you even more as then ebay lays blame on you the buyer making it difficult to recover your money)
Just discovered that paypal and ebay money back guarantee does not apply to motor vehicles :o

I spoke at length via chat to the seller who is now claiming he is a scammer( when I know clearly that he is not)
I found him and his business on all social media( as he also did for me)
He is being a total prick asking me to go to the police etc....
He seems to know all the loopholes.
In all my life dealing all over the place I never met such a prick.
I have filled up the fraud police form with all the necessary details. Going to the police is a bit difficult face to face as am living in Malta.

I have all the chat history where he also has the cheek to tell me to send the same amount via western union so as to refund me the money I paid through paypal.
He also said he is spending my money etccccc
I need your help to know what to do. I always dealt with relatively honest people all my life and that's my guiding maxim. :tumbleweed:
 
Did you pay the paypal via your credit card or from your paypal balance, if via the credit card thats where i would go first if paypal cant help.

Via credit card. Meaning?
 
Via CC means you are protected via your CC. I did the same with PayPal. They were not helpful, I invoked the CC company and they clawed it straight back from PayPal.

That is the reason I never validate my PayPal account with a bank account, but your first call should be CC now as it is fraud and you will be covered via that. They were very good in my case, I even featured in Which magazine with it as I took PayPal on and won :D
 
Sorry can't help specific shawna but i for one didn't know that motors had no cover through paypal so thanks for highlighting that .
Also worth adding there is also a scam if you sell via ebay/payapl .
A chap i buy alloys off was stung £1200 recently & paypal offered him no help .
He sold a set of Bentley alloys+tyres to a guy who paid via paypal & then arranged his own collection , sure enough a whitevan man turned up & took them away , few days later the seller claimed back his £1200 claiming no item received :o paypal duly removed the £1200 & refunded the criminal because the seller had no proof of the collection :thumbsdown:
 
Its a double edged sword.

Ebay should prohibit buying a car via paypal. It should be WELL explained. BUT ebay and paypal offer no protection to the buyer AT ALL when the item is local pickup only. I cant imagine how your guy lost the case since he is very well protected as a SELLER in your case. He must have lost his case as he arranged for delivery and then the buyer arranged for pickup in which case yes he will lose the money as EBAY protects items being DELIVERED.

But in this case the seller wanted paypal, which i complied with seeing its a small-ish amount.

I spoke to my bank who will escalate to a dispute only when the transaction is complete - i.e. the money has been fully taken out of the banks account - at the moment its showing as blocked in my account.

I hope all this fountain of knowledge accrued with this unfortunate incident does not cost me 1K - thats quite an expensive way of learning the scams and loopholes.

I always try to avoid ebay but certain items can only be purchased off there. In this case it would have been a fantastic little present for my dad.

Yes the bank will take action only when the transaction is 'complete' - that is the money is not only blocked from my account but also debited.

In the meantime I also blocked the credit card from which the transaction took place - I hope that an eventual refund(if it arrives) wont be affected by that.

Not quite with you regarding the blocking of the CC, if the transaction is already on there - the blocking will not help?
 
I loathe the whole ebay/paypal monoply but they appear to have cornered the market on both fronts so hard to avoid either at times .
Sooner there are other alternatives for consumers the better ,
I don't expect to sell via ebay for nothing but taking a % from the P&P that is on a sold item :( makes me seethe just thinking about it :thumbsdown:
 
You shouldn't need to block the credit card as the seller cannot put another transaction through on it - paypal does not pass your card details to them. However the above advice is correct, and your card issuer will initiate a chargeback when the funds are settled to the seller - which it seems they haven't been yet. Not sure how it works with Paypal, but usually the seller (merchant) has 21 days from the issuing of a chargeback to dispute it, and they have to prove that the goods were delivered, accepted by you in good condition with delivery notes etc. otherwise the money is simply recovered from them. Many merchants don't even challenge chargebacks, though paypal probably will. In any event, you have lots of evidence so it should be sorted to your advantage.

You are right but its done now will wait for a new credit card soon.

The transaction is there - i wonder if there will a problem to get refunded if ever since the card is now blocked?
 
As above i have done this in the past when Paypal were being next to useless. To summarize my story - I bought a £500 item on Ebay which was a signed delivery - but the box was empty!! The scammer then had proof of delivery and filed a form saying i offered to return the item for a refund.. but i had no item!

Blocking the card wont make a difference as its with the CC company not the individual card. The main thing is you are protection.. under section 75 of the CC agreement purchases over £100 are secure - so dont worry about it.

If you have informed the Cc already then you can just wait and relax a little.. once the statement comes you wont have to pay that amount and let the CC reclaim the amount from Paypal.
 
Shocking and quite an eye opener.

As every one is saying you should be protected for a credit card purchase. Also consider contacting Legal aid for advice https://www.justice.gov.uk/legal-aid and Citizens advice - http://www.citizensadvice.org.uk

I had some really poor garden work done which left damage to my property and contacting citizens advice helped me understand my legal position. They actually sent me template letters and also looked into the company and eventually had its struck off.
