E89 20i - Hill Assist

Come on, I've got billing targets, be fair!

£17.50 for a letter in or out assuming that takes me less than 6 minutes. The post a couple above was much more like 3 units so treble that...

Actually to be fair to our solicitor man here, he could write us group letters for each of us as an individual to BMW UK...

Groupon deal my good man? Haha

While that does seem fair, I don't recall signing a contract. :)

UK laws are sooo different than the US. Possibly the hardest part of moving here.

So, regarding my parking sensors debacle http://www.z4-forum.com/forum/viewtopic.php?f=23&t=38367&p=538105&hilit=Parking+sensors#p538105

Today we found out that the dealer has taken £350 from BMW on our behalf, which we knew nothing about, and apparently they 'put the money towards fitting the parking sensors' on my car.
Got told that if we get in touch with BMW then they won't do anything to help as they have already paid out for our car.
Bearing in mind that after they agreed to fit the sensors my husband rang to clarify that they would be oem standard ie flush fitting and body coloured and our original salesman assured him the aftermarket fitted sensors would be oem standard.
The senior sales man today said, when this was pointed out, that the salesman wouldn't know what oem meant. (Trading standards said that the dealers are responsible for what their staff say).

Spoken to trading standards about the situation and they said that under the Supply Of Goods Act (goods werent sold as described to us) we are entitled to damages and/or compensation. We agreed on compensation by way of the dealer fitting parking sensors and also they told us they would be oem standard so they have to rectify the situation and to provide what they promised.

The people that fitted the sensors told us that there is a better quality kit they could've fitted (meaning dealer got them to fit cheapest kit in the first instance) but still not flush but 'flusher' and there are also flush ones they could fit. They have to bond them onto a plate behind the bumper which, he said, is tricky and he didn't really feel comfortable fitting flush to my car as its a beautiful car and he didn't want to mess it up or damage it (or words to that effect).
They have done a cracking job with the ones they have fitted so they aren't cowboys by any means and I would recommend them to anyone for aftermarket jobs so it's not them I have any sort of problem with.

It's been left now that the dealer is talking to the sensors people to see if they will fit flush. Trading standards lady said that if they do and the car gets damaged etc then again, the dealer has to put it right. Also we are within our rights to return the car to them if they fail to do so or because they sold goods that werent as described in the first place.

What are your thoughts on them taking £350 off BMW on our behalf without telling us and/or your thoughts in general?

(any views are welcome and appreciated but please put them in an intelligent, respectful manner which is usually the way on this forum, if you are going to have a go, thanks)

Hmmmm!

In a nutshell this is absolutely terrible customer service and really Del boy style tactics by fitting the cheapest possible kit.

In fairness, they did agree to fit the parking sensors so they needed the 350 to offset their costs.

In conclusion, I would not be happy in the slightest. If I had the option, I would take the car back and go for something else!

I'm not worried about the £350, we told them we never wanted any cash. I'm just a bit smacked of gob that they took money on our behalf without telling us about it.

I'm having to reign my husband in because if I so much as blinked about taking it back he would. :(

Just give them the chance to put it right and if they don't, take a firmer hand and copy the world and their uncle into emails and letters, including Germany...complain intelligently and with a firm hand...

Actually not telling you about the £350 is sneaky, but at the same time, irrelevant - you agreed the only compensation you wanted (through negotiation) was the parking sensors, so they were entitled to do whatever with the money - effectively you got more than the £350.

However, you didn't get the OEM sensors, which is where the issue is.

Also, thats crap about the salesman not knowing what OEM means....surely thats a requirement in that job!

If you return the car, will you lose out on the finance deal/discounts?

Another option would be to say you want it put back to beforehand (i.e. no sensors) with perfect bumpers, and then take the £350. Doubt that'll happen though.

Will do Mr Stark. Friend of mine gave me the necessary contact details for BMW's national customer service manager

Agree, sneaky but fair enough.

No, I don't think that'd happen. They'd probably have the car back before they'd do that.
Might be worth suggesting to them tho.

Ok. I'll be a little cheeky.

They were given £350 by BMW, but installed the £250 variety and kept the change!!!!

If the dealership accepted £350 without your knowledge then they are now responsible, even if it means them being out of pocket to supply the quality item. I'm no solicitor though so just a guess.

Personally I would upgrade to the bigger engined car that you can option the hill assist. Would that be something you would consider? You may have to pay a little more.
Good luck.
Costa.

Yeah, I think you probably right. Can't see them paying more than £350. I reckon they could've made a little profit there. Be interesting if BMW ask to see the bill.

Maybe they'll upgrade me with no extra cost.

Guys - those of you that received monetary compensation for the lack of hill assist, did you have to sign any form of paperwork to say you had accepted compensation when you received it?
