Wow, I just won a hardtop on eBay and tried to complete the sale and the seller is being a right jerk! He insists that I pay £850 in full over Paypal to which I responded that I would pay a deposit of £200 and then the rest in full when I go to pick it up - seems fair right? I mean I'm not paying £850 for something over eBay that I haven't seen (Paypal only protects up to £500 and only if the seller has 50+ +ve fb - but this guy only has 20). I offered him cash on collection or Paypal, its not like I'm taking the hardtop home and then paying him, I'll pay him then and there. Then he said he wouldn't fit the hard top on for me because it cost him £40 at BMW dealer to do it (even though in earlier emails he said he would) Is it really that difficult to fit it on?? I'm about to drive 5 hours back and forth - I don't think I'll be messing around(!) After much negotiating he huffed and puffed and said fine I can pay the rest when I come pick it up and then added a little sly comment that he hopes I won't come knocking the agreed final bid down?! I mean wtf? (apologies but I'm just about steaming by now) :headbang: Then when I commented that he was implying that I was a buyer with no intention to pay, then he starts throwing insults at me and saying that I'm scum basically and can't afford it and that I'm wasting his time! :tumbleweed: I'm thinking, huh? The guy needs to chill out! Anyway the deal is off and if he gives me -ve fb (I've got 200) then his -ve fb is going to affect him more with only 20 fb! :x

Sounds to me likes he's not happy with the price you won it for and is now trying to trump up reasons not to complete the sale.

The win is a legally binding contract and you can insist on completion of the sale

There is no fitting to do. Drop it on turn 3 catches in less than 15 seconds and it can be fine tune adjusted when your back home. Drop by my house ont he way if you wish and I'll demo fitting and lend you the tool (allen key) in case he does not have it.

Well she said the deal is off so the only reason to go there with a large male homo sapiens is to make him familiar with Mr. Crowbar but i doubt if she wants to do that :D Actualy scratch that maybe she does want to but i dont know if she should hehe.
 
On the other hand, having myself been the victim of a scoundral purchasing an item from me, I can see the other side. Without seeing the terms posted it's hard to determine. If the seller posted the terms prior to auction, i.e. payment in full at time of close, then finding someone wanting to change the deal after bidding wouldn't sit well with me either.

Although 5hrs is a long way, it's not impossible certaintly to make that drive out and back in a day. Tell him you'll come same day and take the full bid amount in cash.

A reason to take the Zed on a 10 hr trip? Sounds like a lunch run to me.
 
If you pay by paypal, it's going to cost the other guy money. so to me a deposit would be the best way, if I was a seller and somebody won it but said they werent collecting for a week I might ask for it, other than that cash on delivery seems very reasonable.

It's probably better that you didn't get that hardtop. By that comment alone, I'd assume that he's afraid that when you come to see the item, you might not want to pay the winning bid because the quality of the hardtop in reality is not the condition implied on the ebay offer. "Good Condition" could mean a lot of different things to different people.

Now the guy is threatening to take me through eBay procedures for non-payment unless he receives full payment by Paypal before I go to see the hardtop! Unbelieveable! Who doesn't accept cash on collection? I was willing to pay a deposit first and then pay the rest on collection. I'm not paying £850 in full before seeing the hardtop! Its the guy's attitude and the language he uses thats really putting me off buying from him, if he was 'nicer' and more 'polite' in his emails then maybe I would consider paying him in full on Paypal, and if he would just fit the top on for me! Gosh how hard is it? :x

oh well...
 
Do you have a link to the item or the terms of payment that was on the auction?

I think its perfectly reasonable to pay a deposit via paypal and cash on collection, two similar hard tops currently for sale have this stated with a deposit or ~£150.

Why would you want a hard top anyway, its getting sunny! :P

make sure you keep all his emails, if he takes you through the ebay process you can pass them to ebay, should help you, as I also dont think you are being unreasonable in offering a deposit and balance on collection.
 
Some people just dont know how to behave... What can you do eh? Look if you think the hardtop is worth it go for it and then forget about the whole thing. Or on the other hand go straight through eBay yourself before he does and tell them how he acted (with proof like srhutch said ). If the auction clearly states paypal only though they may just say "Well you agreed to these terms and there's nothing we can do."
 
As a extreme E-Bay user (seller and buyer) you may not have any recourse.
You better go back and read the payment options again. If it only says paypal, you may not have ANY recourse but that route. If you do not pay via what stated on the auction page, he has every rite to start arbitration and give you a negative feedback... of course ebay arbitration may side with you if you can prove that you had the cash to pay with.

I know that is not what you wanted to here, but that is the way it is...

Now, a straight up seller, since he is close to you, SHOULD be able to accept cash.. It will cost him less money in the long run... less paypal charges. Ebay will still charge him the same because the item sold....

Yes, I would be a little wary of this seller. What is his feedback rating? Has he sold one or two things, hundreds or thousands...
I always check the feedback ratings when I about to spend more than $100.00

I just reread your first post.

When he said "fine I can pay the rest when I come pick it up" was that in an email? God I hope so. If so, then Ebays rules are on YOUR side. You negotiated an mutual payment and now he is trying to back out..... If you have an email stating this, then call his bluff and say, 'Contact Ebay, I have your emails that say paying you cash upon pick up was satisfactory with you and now YOU want to back out"

If there is nothing in the auction writeup about fitting the top, then he does not have to. But it would be a nice thing to do.

The guy does state Paypal as the method of payment. The thing is, I have no problem paying via Paypal, I've paid for everything I've bought on eBay over the past few years using Paypal, but I don't want to pay the whole amount via Paypal without seeing the item first because 1) they only protect up to £500 and 2) that is only if the seller has more than 50+ve fb, and this guy only has 20! So for those reasons which I explained to him - I would only be willing to pay a deposit up front. I mean I can pay the remainder in Paypal as well if he wants - just only after I've seen and checked the item! Its not like I'm paying him less or scamming him!

The bit about going to the dealer to fit it on - fair enough it doesn't exactly say "I will fit the hardtop on for you", but I guessed any normal person would help you out and put the hardtop onto your car since I've heard it only takes about 30 seconds. But being the kind of person this guy is - I guess not, but fine I accept that I shouldn't have assumed he would help me put it on :o
The main thing is, I've kept all our emails so if I'll have back-up if eBay questions me about it. What a hassle and pain this has turned out to be! :?

So if anyone out there that wants to get a hardtop please please please do not get it from this guy to save you the hassle, no doubt he'll be relisting the item again soon.

To cj10jeeper: Many thanks for offering to show me how to do the adjustments, looks like I still just need to purchase the important part first! :lol:
 
So the deal is definitely off then.. Look the guy doesnt mention anywhere in the auction that he accepts cash on pickup and mentions Paypal only so i guess you can't force him to accept cash even though that is entirely reasonable... I say talk to the guy again and explain *again* that you ARE willing to pay the full price but only 200 as a deposit from Paypal and the rest on pickup. Explain to him that he is getting more money that way! It's not like you are asking for him to ship the hardtop to Nigeria as a birthday present for your "girlfriend" and that you'll pay by Western Union as soon as you get the item... If you really dont want to deal with him again just accept his negative feedback and that's that.

Oh and if you do buy the hardtop off him as others mentioned go with a friend so that he wont give you any attitude. He probably wont as the Internet has a side effect of making a few people feel braver when in person they would just sit quietly in a corner and nod but anyway just in case.
