damaged van legal advise

I was in a yard yesterday and there was a pice of steel left on the ground wich I could not see as I drove over it the steel ficked up and hit the side of my van causing about £300 of damage the roadway was tarmack with a thin layer of mud over it thats why the steel could not be seen ,

If it was my old van I would not have worried to much but its my new t5 transporter wich I take care of ,the owners of the yard where quiet indignant and said it was just one of those things and tuff s***t which really wound me up so I managed to get there public liability details out of them dose anyone think I will get anywhere or shold I just bite the bullet and pay for the damage myself (ps no signs up saying anyone entering this yard do so at there own risk etc)
 
I'd say that one would all come down to deciding if the yard owner was negligent in leaving the metal there or not. If he say stacked a pile of metal and it fell on your van he'd be responsible. If a bit happened to lay invisible in mud and he could not reasonably know then I think one of those things.

I'd also argue that if you drive a van into a yard on a mud covered road you accept a level of responsibility for so doing.
 
there is probably an argument that they were negligent not ensuring that it was safe for you to enter / exit

but it could well end up being a right old fight with the insurance company. although £300 isnt pocket money for most it isnt a massive amount.

All boils down to if you want to fight for it or not. is it worth your time?

Think i'd be tempted to give it a go.

Not a good day my wife Just reversed her ford focus into the zed small dent and scratched the wing + the back bumper on the focus on top of that a week ago the wind has blown the garage door on the on to the back bumper of the touareg and scratched that so all my vehicles need to go to the body shop now :headbang:

update I rang my mate who works in a body shop he said to pop it over for a look 20 mins later damage gone on the zed
 
Good, really glad its sorted, now why don't you take the piece of steel that damaged your car and bend over the head of the arsehole who owns the yard :thumbsup:

It was van that got damaged by the steel bar , I have been in touch with there insurance company today I spoke to a verry nice lady who said that it was a legitimate claim , I have sent all the details to her , she has informed me that the owners of the yard have to inform them of any incedent that hapens in the yard regadles of the amount of the claim my phone call was the first they herd of it so I hope that drops them in the sh1t , so looks like they will pay for the damage on the van happy days :thumbsup:

were there is blame - there is a claim.....(must stop watching daytime tv me thinks)
 
That's a result. Wait until it's paid then you can be real smug and know his premium will be higher at renewal time :thumbsup:

how were the black mountains on sunday? road conditions good?

roads where good but we have snow now the zed's in the garage untill the sun comes out may pop down to the piston heads brekfast club at the Big Bite Cafe Cross Hands postcode is SA14 6NT next sun 28th feb not far for you to come be nice to see another z4 down there
