Would fail an not, could blow suddenly, having said that I used mine as a spare and replaced it years later and it was still OK.

If it's not deep enough to show the ply/cords, then there is no need to repair/replace - and that's exactly what some of the 'rim protectors' on tyres are for. But get it checked out.

Don't be tempted to glue it - as the MOT tester will want to check that it isn't down to the ply/cords. If they can't then they may fail it due to not being able to check.

Important to note is that the inside of a tyre contains ply and cords which can become exposed if the tyre has a deep cut in the tread or sidewall.

According to UK road law, if a tyre cut is 25mm or 10% of section width – whichever is greater – then these are grounds for instant MOT (Ministry of Transport) test failure. A cut of this size is considered deep enough to reach the ply and cords.

If you discover a cut on the tyre surface before your MOT test, either on the sidewall or the tread, then it's advisable to replace it with a new tyre. An attempt to have it repaired is not recommended, and for the sake of tyre safety it mustn't be ignored.

Just taken it down to Halfords to replace tyre before the MOT this afternoon, he said it doesn't need replacing thankfully

Looks like a nick to the rim protector part of the tyre , probably looks way worse than it actually is there in the pic .
Pull it some more , take a look , id even consider supergluing it back just to prevent it possible getting any worse .
As for the rim  better call Lynchy :)

The rim protector is thicker rubber so I would glue it back down. What numpty hit the kerb though
