Couple of issues spotted

Hi, just had wheel alignment done after replacing suspension parts and the garage pointed out a couple of issues nothing to do with the suspension.

First is the valve for the exhaust driver side is broken and always open. Can this be repaired or should I just leave it?

Second is an earthing strap is hanging loose on the rear passenger side near exhaust. Any ideas where this should be?

Looks like a bit of vandalism…no harm apart from irritating others will come from a broken exhaust valve flap..

There are a couple of bonding points …I assume a muppet damaged that too..those need fixing
 
I wonder if the valve was opened permanently for sound enhancement.

Car is a 2010 35i.
The exhaust valve is probably stuck open because the actuator or linkage broke. You can leave it open if you do not mind a louder exhaust sound, but replacing the actuator is the proper fix. The loose earth strap should be reattached to the chassis or exhaust bracket nearby. If it is damaged, replace it to avoid possible electrical grounding issues later. Thank you so much!
