Country lane head ache..

Hi guys. Travelling to work along a country lane (little hay) nr Lichfield. I was following a work colleague when I noticed a large hgv had narrowly missed here and was heading for mine! :thumbsdown:

Anyhow the hgv didn't slow down much so I decided to pull left as far as I could and stop the vehicle.. As I was waiting for his judgment (well there wasn't any) he missed my wing mirror by a mm and carried on to take out my back rear arch out!!

Here was absolutely nothing I could of done. I was stationary and he carried on to hit me and weren't gonna stop! I seen out my rear view mirror that he carried on driving 10 metres down the road, I binned my horn and started to reverse as I thought he was driving off.. Luckily by this point he stopped and got out. Very apologetic and said he couldn't go anywhere else. He acknowledged I was stationary and that he went into me! Good news right? Apparently most country lane incidents are 50/50 :thumbsdown:

I phoned my insurance company esure straight away and they then went on to put me through to Albany car hire.. This is where I am worrying. I am still waiting for his insurance to admit liability and yet they are putting me in a £200 a day car (yes that's right) so if they have my car for 30 days that's a nice sum of £6000!!!! Plus I had to sign a hire agreement also with added protection that I wasn't paying a penny. Albany said that they only hire cars out that they know I am not at fault. Esure also said that they cover half the cost if it's 50/50..

So after a whole weekend of worry, I'm worried that he will make up a story and the fact that I have signed a hire agreement for £200 a day, which I don't think I will pay anything.. The colleague in the front witnessed the whole thing luckily, but as I know her I'm not sure how well it goes down?

What would you guys do?

As you can see from the damage, I'm not sure if this requires a whole new panel, that's pretty much the whole of the drivers side!!! Can this be replaced?
 
Well I'm not an expert by a long shot but I've seen a few car repair programmes in my time and it looks to be pretty superficial damage that a competent bodyshop would be able to fix with some filler
 
Bodyshop will probably use a pull hammer or similar to pull most of the dint out then a skim of filler to bring it to the correct depth
 
You have a duty to mitigate any costs, so if you can afford a hire car out of your own pocket @ £50 a day then do so.

Alternatively ask the 3rd party's insurer to give you a loan car.

I got into a lot of bother when I was 'loaned' an M3 for 2 weeks by an accident management company. My only saving grace was the fact that my bank/cc statements showed I couldn't afford to fund a hire car out of my own pocket at the time (due to a client not paying me the £16k they owed me for 9 months).
 
Well if the happen to run a magnet over the repaired area they would be able to tell, but if the bodyshop is any good the repair should be not apparent to the naked eye
 
Thanks buddy, fingers crossed they choose a good one then and by this time tomorrow the idiot in the van admits liability
 
Good news, his insurer confirmed they are at fault and are admitting liability.. I am sending this £200 a day hire back and using his insurance company for repairs and hire car. Luckily their approved bmw garage is bmw sytner in Olbury
 
Sounds like you have it covered. Quite right to get a cheaper hire car, that is one area were the insurace can and sometimes do, ask for money back.
 
Just to add I was put through to Albany from Elephant when some fool wrote my car off a few years back. Gave me a brand new Scirocco hire car through Helphire that I thought was excessive, naively I went along with what they said, other party admitted liability and all costs were covered luckily. They were perfectly good with me to be fair but if I wasn't 100% sure the other party was at fault I would leave well alone. You should be fine though by the sounds of it liability wise
 
Thats a nightmare for you, glad it has turned out okay on the liability front. It would not have surprised me if they tried knock for knock the swines.
 
so the at fault insurer is paying for the credit hire costs for the little time you did have it?
 
I had a problem with an Albany hire car a few years ago, they put me in a 635d for a couple of weeks, the other side's insurance were going to go to court up until the week before, very unpleasant for me. I've vowed that if it ever happens again I will ask for the cheapest car they have available just in case!
 
Yes delivered as there's was picked up. It's similar c200 saloon amg 63 plate. Enterprise car hire. £80 a day opposed to £200 for a coupe lol
 
That's horrible :(

This sort of thing keeps me away from the back roads. I have only had my Zed 2 weeks and I have been down the lanes only once!
Far too worried to get knocked!
