Took this off BMW website and it doesn't say anything about roofs being exempt !
Trading Standards or solicitor next :?

There is nothing in the BMW extended warranty about excluding the roof motor for E85s but that doesn't stop Alliance rejection out of hand a Dealer claim for motor replacement despite area being clean and dry

Has anyone actually gone to court over this issue or did people just take it in the ass

Having looked at BMWs anti-corrosion warranty on line I can't see anything that specifically excludes the roof from the warranty. It does mention rust, I suppose any aluminium panel might be excluded as it doesn't rust!
I would write to BMW UK asking for a written statement explaining their refusal to cover defect under warranty, ask them to identify the parts of the warranty that clearly indicate that the roof is not covered. Point out that the dealer & BMW have accepted that this is a corrosion issue caused by poor manufacture process and that in the event of no satisfactory response within 21 days you will issue a claim against them for the total cost of repair and your costs and expenses.

I had both my roof panels painted at BMW under warranty for exactly the same issue

Really, now that is interesting. Did you also get new panels as well? This could be really helpful if I quote your car details to specialist cars who are trying to fight my corner with BMW uk at the moment
(I've emailed you about this  )

I hope so Rob providing it was another E89 and done under the 12yr corrosion warranty and not the 3yr paint warranty.

Bloody hell Paul, so glad I have a fabric roof :P
But really, this is quite appalling mate, looks like you need to go legal after all. Hope this gets sorted to your satisfaction.

Even I had better service when my fabric roof in my E88 got a hole which started from the inside due to a badly designed frame. Bill was over £3k to fix, was out of warranty and BMW goodwill meant I only paid £170 which was for the coding a testing once it was installed. In my case though BMW had recalled in the US on the issue but never elsewhere as supposedly the fact roofs aren't put down as much ment it possibly wouldn't happen or happen as quickly.

Although the installation was never as good as the original roof and that lead to the need to change the car.

The car is not on finance by any chance is it? If it is and memory serves you do have some sort of recourse through the for the "goods not remaining of a satisfactory quality". I had a similar experience with a Mini BMW refused to repair properly due to corrosion and in the end I rejected the car and returned it to the finance company (BMW Finance) at the time the car was about 4 years old or so.

Just thought I would mention it in case its helpful.

Thanks for this but there's no finance involved. I had a plan to move forward until Z4M-2006 said he'd had warranty paint done on his so this might save me court dealings with any luck

No..

I didn't get new panels, but to be fair the extent of the bubbles was much less than yours... But they shouldn't be there at all was my thinking and BMW repainted without any problem...

PM me if you require any details

I've finally had a warranty claim approved thanks to Specialist cars and a new roof is heading my way :D thanks everyone for all your advice

Great result. So glad it's being fixed  let's just hope they do s good job and don't cause any further grief.

I'm sure it'll all be fine and I know you'll go over the car scrutinising every inch upon its return.

Well done for persevering!

Who are Specialist Cars? I've tried searching but there are many.

Are they a body shop or something else? How did they have influence on the decision?

It'll probably help people going forward. :)
